1.1.07354 Councilmember Zimmerman introduced the following resolution and moved for its adoption: . RESOLUTION #94-02-041 A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT FOR AN ACCESSORY APARTMENT IN A SINGLE FAMILY STRUCTURE IN THE R-l RURAL RESIDENTIAL . WHEREAS, Cathy Gustafson has properly applied for a conditional use permit ("Permit") to maintain an accessory apartment within the single family dwelling in the R-1 Rural Residential District on the property generally known as 15823 Nowthen Blvd. N.W. and legally described as follows: That part of the Southwest Quarter of the Southwest Quarter of Section 14, Township 31, Range 25, Anoka COUIlty Minnesota described as follows: Commencing at the Southeast comer of said Southwest Quarter of the Southwest Quarter which point is the intersection of the South line of said Section 14 with the centerline of County State Aid Highway No. 5; Thence North 0 degrees 36 minutes 25 seconds West along said Cente:dine a distance of 224.10 feet; thence Northwesterly on a tangential curve to the left having a radius of 442.92 feet and having a delta angle of 37 degrees 57 minutes 15 seconds for a distance of 293.40 feet; Thence North 38 degrees 33 minutes 40 seconds West along said centerline and tangent to said curve a distance of 447.0 feet to the actual point of beginning of the tract of land to be hereby described; Thence continuing North 38 degrees 33 minutes 40 seconds West,along said centerline a distance of 290.90 feet; Thence North 69 degrees 40 minutes 20 seconds East to its intersection with the East line of said Southwest Quanerof the Southwest Quarter; Thence Southerly along said East line to its intersection with a line having a bearing of North 89 degrees 42 minutes 50 seconds East and drawn from the actual point ofbeginmng; Thence South 89 degrees 42 minutes 50 seconds West a distance of 360 feet, more or less, to the actual point of beginning (for the purpose of this description, the South line of said Section 14 is assumed to have a bearing of East and West.) WHEREAS, the Planning Commission met on February 1, 1994, conducted the public hearing and recommended City Council approval of.the request NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1 , Based on Findings of Fact #0354, a conditional use permit (the "Permit") for an accessory apartnJent within the single family dwelling unit is hereby granted to Cathy Gustafson, (the "Permit Holder"), at 15823 Nowthen Blvd. N.\V. (the "Subject Property"). 2. That said Permit shall remain in effect so long as the conditions imposed herein are complied. with and the property owner maintains residence in one of the two units on the Subject Property. 3. 'TI1at the structure exterior shall maintain the appearance of a single family dwelling unit. 4. That the structure shall not be further altered to render it marketable as a duplex or the accessory apartment as a condominium. ) .
