introduced the following resolution and moved for its adoption: Councilmember RESOLUTION #04- A RESOLUTION APPROVING THE ISSUANCE OF AN AMENDED CONDITIONAL USE PERL\tIlT TO ALLO\V AN ACCESSORY APARTMENT IN A SINGLE FAMILY STRUCTURE IN THE R-l RESIDENTIAL DISTRICT \VHEREAS, Kevin Block, Barbara Rice, and Gary Sandberg (Permittees) have properly applied for an amended Conditional Use Permit (CUP) on the property generally known as 15823 Now1hen Blvd. and legally described as follows: That part of the Southwest Quarter of the Southwest Quarter of Section 14, Township 32, Range 25, Anoka County Minnesota described as follows: Commencing at the Southeast corner of said Southwest Quarter of the Southwest Quarter which point is the intersection of the South line of said Section 14 with the centerline of County State Aid Highway No. 5; Thence North 0 degrees 36 minutes 25 seconds West along said Centerline a distance of 224.10 feet; thence Northwesterly on a tangential curve to the left having a radius of 442.92 feet and having a delta angle of 37 degrees 57 minutes 15 seconds for a distance of293.40 feet; Thence North 38 degrees 33 minutes 40 seconds West along said centerline and tangent to said curve a distance of 447.0 feet to the actual point of beginning of the tract of land to be hereby described; Thence continuing North 38 degrees 33 minutes 40 seconds West along said centerline a distance 01'290.90 feet; Thence North 69 degrees 40 minutes 20 seconds East to its intersection with the East line of said Southwest Quarter of the Southwest Quarter; Thence Southerly along said East line to its imersection with a line having a bearing of North 89 degrees 42 minutes SO seconds East and drawn hom the actual point of beginning; Thence South 89 degrees 42 minutes 50 seconds West a distance of 360 feet, more or less, to the actual point of beginning (for the purpose of this description, the South line of said Section 14 is assumed to have a bearing of East and West.)(the "Subject Property"); and WHEREAS, the Planning Commission met on October 7, 2004, conducted a public hearing and recommended City Council approval of the request.
