Commissioner Brauer introduced the following resolution and moved for its adoption: <br />RESOLUTION #17-04-081 <br />RESOLUTION ADOPTING FINDINGS OF FACT #0979 RELATING TO A REQUEST <br />FROM STEVE AND CHRISTINE ROEDER FOR A VARIANCE TO THE SIDE CORNER <br />YARD SETBACK REQUIREMENT. <br />WHEREAS, Steve and Christine Roeder, hereinafter referred to as "Applicant," has <br />properly applied for a variance to the side corner yard setback requirement established in Section <br />117-111 (R-1 Residential District) of the Ramsey City Code on the property generally known as <br />15359 Zuni Ct. NW and legally described as follows: <br />Lot 9, Block 1, Highlands at River Park 4th Addition, Anoka County, Minnesota <br />(the "Subject Property"). <br />NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant submitted an application for a variance on February 16, 2017. <br />2. That the Applicant appeared before the Planning Commission for a public hearing pursuant to <br />Section 117-53 of the Ramsey City Code on April 6, 2017 and that said public hearing was <br />properly advertised, and that the minutes of said public hearing are hereby incorporated as a <br />part of these findings by reference. <br />3. That the Subject Property is zoned R-1 Residential (MUSA) and is approximately 14,810 <br />square feet (0.34 acres) in size. <br />4. That the Subject Property is surrounded by properties also zoned R-1 Residential (MUSA). <br />5. That the Subject Property is guided as Low Density Residential on the Future Land Use Map <br />as are the surrounding properties. <br />6. That the Subject Property is within the Highlands at River Park, 4th Addition subdivision, <br />which plat was recorded in 2004. <br />7. That Section 117-111 (d) of the Ramsey City Code establishes a corner side yard setback of <br />thirty (30) feet from the right-of-way of public roads for accessory structures on properties <br />within the R-1 Residential (MUSA) District. <br />8. That the Applicant is requesting a six (6) foot setback from due to the irregular shape and <br />layout of the Subject Property. <br />
