Here is the City's proposal for moving <br />forward using Option 2, which moves the turn -around off of your client's property and avoids moving the existing <br />electrical pole: <br />City obligations: <br />• Obtain consent from the property owner to the west to provide an easement, and draft the easement for <br />recording. <br />• Retain Hakanson to design the requisite plans and specifications at the City's cost. <br />• City to provide surveyor to stake the easement area and turn -around. <br />• Provide at no cost the Class V material needed for construction. <br />• City to pay its own legal fees. <br />Schmitz's obligations: <br />• Pay for construction costs, including Hakanson's project administration costs and inspection fees. <br />• Transport gravel from City reserves to the construction site. <br />• Schmitz to pay his own legal fees. <br />Please advise if your client accepts these general terms.
