Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #17-05-117 <br />RESOLUTION APPROVING AN ENCROACHMENT AGREEMENT FOR A SPORT <br />COURT TO BE PARTIALLY LOCATED IN A DRAINAGE AND UTILITY EASEMENT <br />ON THE PROPERTY GENERALLY KNOWN AS 7496 161sT AVE NW AND <br />DECLARING TERMS OF SAME <br />WHEREAS, Clinton and Monica Seul, hereinafter referred to as the "Applicant," have <br />requested an Encroachment Agreement to allow a 29' x 29' sport court (the "Sport Court") to be <br />partially located in a drainage and utility easement (the "Easement") on the property legally <br />described as follows: <br />Lot 4 Block 4 SWEETBAY RIDGE <br />(the "Subject Property"). <br />WHEREAS, the Applicant has applied for a Zoning Permit for the Sport Court; and <br />WHEREAS, Engineering Depaitinent has found that the Easement can still function with <br />the encroachment of the Sport Court; and <br />WHEREAS, City Council reviewed the Encroachment Agreement request on May 23, <br />2017. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That, contingent upon the Applicant entering into an Encroachment Agreement with the City <br />and recording said agreement against the Subject Property, the Applicant may construct and <br />maintain the Sport Court in accordance with the terms and conditions contained within the <br />Encroachment Agreement. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />, and upon vote being taken thereon, the following voted in favor thereof: <br />and the following voted against the same: <br />and the following abstained: <br />and the following were absent: <br />whereupon said resolution was declared duly adopted by the Ramsey City Council this the 23rd <br />day of May, 2017. <br />
