4) Consider Feasibility Study on St. Francis Boulevard Frontage Road <br /> <br />Moved up in the agenda to follow Case 4/1. <br /> <br />5) <br /> <br />Snow Removal Issues in Ramsey Town Center <br /> <br />Assistant Public Works Director Olson reported the Public Works Committee ran short on time <br />for this discussion. The motion was to table the discussion of the topics and take them a few at a <br />time at upcoming Public Works meetings. There is a long list that needs to be discussed, and <br />they will address two or three of the issues per Public Works Committee meeting. <br /> <br />No Council action required. <br /> <br />Case #5: Nuisances Affecting Public Peace <br /> <br />Police Chief Way indicated this issue has been discussed at length. Staff recommends amending <br />Scction 5.08 "Public Nuisance" by repealing the existing section and replacing it with the new <br />Section 5.08. <br /> <br />Councihncmber Strommen commented she checked and it was determined this ordinance does <br />not require a public hearing. She suggested anyone with comments regarding this to attend the <br />next City Council meeting when this ordinance will be adopted. <br /> <br />Motion by Councihnember Cook, second by Councilmember Elvig, to introduce an ordinance <br />amending Section 5.08 titled "Public Nuisance: by the repeal of said existing section and <br />replacing it with a new section 5.08, which new section shall continue to be titled :Public <br />Nuisance." <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Elvig, Kurak, Strommen, <br />and Zimmerman. Voting No: None. Absent: CouncilmemberPearson. <br /> <br />Case #6: <br /> <br />Authorizing Acquisition of Permanent Street and Utility Easements <br />Necessary for the Extension of 160th Lane NW <br /> <br />City Attorncy Goodrich explained on July 27, 2004, the City Council reviewed the appraisals <br />regarding tree damage and the possible purchase of a 66-foot wide road easement through the <br />Steve and Christy Dusbabek and Francis and Lori Kaas properties. The City Council voted to <br />acquire the property through negotiations or eminent domain if necessary. Staff is bringing <br />forward a resolution that would authorize the use of eminent domain to purchase the property in <br />order to keep to the designated timeline of all parties. He noted the following amendments to the <br />proposed resolution: <br /> · An additional whereas to state "Whereas the City Council by resolution on July 27, 2004 <br /> established conditions on the use of the easement to be acquired." <br /> · An addition of #8 to state "The permanent easements are to be acquired pursuant to the <br /> conditions established by City Council resolution on July 27, 2004." <br /> <br />City Council/August 10, 2004 <br /> Page 20 of 27 <br /> <br /> <br />
