Cotmci hnember Kurak inquired where Sunwood Drive will continue in relation to this building. Assistant Community Development Director Trudgeon replied Sunwood Drive will be on the north o f this building. Councihncmber Elvig questioned if compliance of signage in the new district should be addressed at this time. Assistant Community Development Director Trudgeon replied staff has not looked at compliance of the signage directly. The TC district does have special signage requirements. One argument is that thc signage is grandfathered in, and the applicant is not proposing any changes in the signagc. Staff is willing to entertain any thoughts of the Council. Councilmember Elvig commented they might not need to address the signage at this time, however, as Town Center is built they may want to look at a more compliant signage relationship. He noted a big illuminated sign would start to look odd as everything starts to quiet down. I te is satisfied with what is there at this time, and the signage can be looked at a future time. Motion by Councilmember Elvig, second by Councilmember Kurak, to approve the proposed site plan for M&W Holding Company contingent upon compliance with City Staff Review Letter dated July 30, 2004, the Applicant entering into a Development Permit with the City, the Applicant installing the pond outlet structure per the approved original site plan and restoring the area, thc Applicant enlarging the stormwater drainage pond to the approved original site plan contours as necessary and establish vegetative ground cover, and the Applicant repairing the washouts on the south slope of the pond and establish vegetative ground cover to help hold the soils in place. Further Discussion: Councilmember Kurak inquired if the grandfather status is taken away when an addition is added to a building. Assistant Community Development Director Trudgeon replied if a building is being added onto and meets current codes it does not remove grandfather rights. In this case if the applicant was proposing to change the sign he would need to comply, but ho is not proposing anything with the sign. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Kurak, Cook, Strommen, and Zimmerman. Voting No: None. Absent: CouncilmemberPearson. Case #7: Nuisances Affecting Public Peace Police Chief Way advised staff recommends adoption of the new Section 5.08 "Public Nuisance" expanded as it relates to public peace. Motion by Couucihnember Cook, seconded by Councilmember Elvig, to adopt Ordinance #04- 34 Adding the new Section 5.08, called "Public Nuisance". City Council/August 24, 2004 Page 10 of 25
