The applicant has received a variance from the Board of Adjustments for the lot width on <br />Lot 1, Block 2. <br /> <br />Commun ity Development Director Frolik indicated park dedication will be a combination of land <br />and cash. There will be 1.01 acre land dedication, cash payment of $1,034, and a private <br />casement to be drafted and recorded by the Applicant to allow for appropriate ingress and egress <br />from the park land to Outlet A, which the applicant will retain ownership of. She advised the <br />City approved a 90-day moratorium affecting the subdivision of lots within the rural developing <br />district that became effective in July. The subject property is included in the recently adopted <br />moratorium, l-towever, due to the fact that the Planning Commission approved the sketch plan in <br />March and staff and the applicant continued to work on the plat to resolve park dedication terms, <br />it seems appropriate to continue with approval of the final plat. <br /> <br />Mayor Gamcc inquired about the easement around Trott Brook. <br /> <br />Colnmunity Development Director Frolik replied an easement has not been taken on the south <br />side of Trott Brook at this point in time. <br /> <br />Eliot Schaeffer, applicant, explained from what he recalls it was a matter of topography on the <br />south side of Trott Brook, which was not as accommodating to a park or trail system as the north <br />side is. <br /> <br />Community Development Director Frolik explained the north area is more conducive to a trail. <br />It is anticipated at some point in the future Mr. Schaeffer may re-subdivide and there will be <br />more park dedication on the south side. <br /> <br />Councihnember Strommen noted the thought was to preserve the natural aspects of the corridor. <br />From that perspective she does not understand why they would not want an easement there for <br />the purpose of maintaining that natural corridor. <br /> <br />Councihnembcr Elvig concurred. He indicated he agrees with Mr. Schaeffer about the <br />topography, but there may be funds set up that could be used to dedicate the land for a corridor. <br />He suggested this be explored to see if it is something Mr. Schaeffer would be willing to do. <br /> <br />CotmcJhnember Cook explained there could be an agreement that the property owner can retain <br />ownership without using that land. This could be done separate of the site plan approval, as the <br />City would not need to retain ownership of the land. <br /> <br />Counci hnembcr Strommen indicated Mr. Schaeffer might want to sell an easement to the City. <br /> <br />Councilmcmbcr Kurak noted there is park dedication on the west side of the property. It may be <br />wise for the City to wait until there is further subdivision at a later time, and to then capture land <br />as a park.
