Mr. Schaeffer stated this has been discussed since there was still snow on the ground. His desire <br />is to have his privacy at this time, and in the future when he subdivides there will be more <br />options foe' other things. <br /> <br />Mayor Gamec indicated the Council has to look at the interest of the City, and also what is best <br />roi' Mr. Schaeffer. Mr. Schaeffer and staff should be able to work this out, and if he disagrees <br />with all of the options he has the right to come back to the Council. <br /> <br />Motion by Councihnember Elvig, second by Councilmember Strommen, to adopt Resolution <br />#04-08-230 approving the final plat for Falconer's Ridge contingent upon the City and the <br />Applicant cntering into a Development Agreement, and contingent on staff and Mr. Schaeffer <br />negotiating an agreement for the City to obtain an easement or park dedication to retain the <br />greenway corridor on Trott Brook. <br /> <br />Motion carried. Absent: CouncilmemberPearson. <br /> <br />Case/412: <br /> <br />Request for Amended Conditional Use Permit to Allow for Expansions of the <br />Green Valley Greenhouse Operations in the R-2 Residential District; Case of <br />John Rowe <br /> <br />Community Development Director Frolik indicated on July 6, 2004, John Rowe approached the <br />City with a request to expand the greenhouse operations at the Green Valley Greenhouse. After <br />reviewing bis future plans for the property, staff recommended that Mr. Rowe apply for an <br />amended CUP that would establish a maximum cap to the size of the operation. It is staff's <br />opinion that operating under a building coverage cap is more efficient than processing a CUP <br />every time there is a need to expand some aspect of the greenhouse facility. However, that <br />approach would not exempt the business owner from the site plan review requirements of City <br />Code for thc more permanent type structures like warehouses, offices, shipping and receiving <br />docks; staff would propose that the greenhouses would not be subject to site plan review. <br /> <br />Community Development Director Frolik advised since City Code restricts building coverage in <br />the R-1 District to 35 percent of the lot area, it seemed appropriate to use that rule as a cap to the <br />size of the greenhouse and related activities. The property owner will also be seeking a <br />subdivision approval to separate the homestead from the business operations. A cap of 35 <br />percent would allow up to 167,271 square feet of additional expansions to the facility. Mr. Rowe <br />has agreed to implement a 65 foot buffer yard around the perimeter of the property. <br /> <br />Comlnunity Development Director Frolik indicated the Planning Commission expressed concern <br />with bringing the existing facility into conformance. Mr. Rowe then presented the Commission <br />with a copy of his Six Year Growth Plan, noting that his immediate need in 2004 is 30,000 <br />square feet of greenhouse space. The Planning Commission amended the proposed findings of <br />fact to reflect Mr. Rowe's immediate need for 30,000 square feet of greenhouse space. One <br />option before the Council is to approve the 30,000 square foot expansion recommended by the <br />Planning Commission, taking a more in depth look at the site as a whole over the next five or six <br /> <br />City Council/August 24, 2004 <br /> Page 17 of 25 <br /> <br /> <br />
