Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland. Hendriksen, LaDue, Terry, and Thom& Voting No: None. It was the consensus of the Commissioner that #16 through g25 would remain as presented. Motion by Commissioner Deemer and seconded by CommissiOner Hendfiksen to amend #26 through #35 in the aff'n'mative. Motion carried. Voting Yes: Chairperson Bawden, CommissiOners Deemer, Hendriksen, Holland, LaDue, Terry, and Thomd. Voting No: None. Motion by Commissioner Deemer and seconded by Commissioner Thorud to recommend that City Council adopt the amended Findings of Fact relating to Kaltec's request for a temporary conditional use permit. Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Thorud, Hendriksen, Holland, LaDue, and Terry2 Voting No: None. The Planning and Zoning Commission proceeded to review the terms of the CUP. Commissioner Hendriksen Commented that it was good to get some benefit out of the landfill, but he was concerned about the pole barn being left standing afterwards and wanted it specifically stated in the conditional use permit that it will be removed. Ms. Frolik stated removal of all structures, etc. was addressed under "Term" of the CUP. Commissioner Deemer inquired about the exterior of the building, and Mr. Rippe advised the building would be wooden with a painted metal roof with skylights. Motion by Commissioner Deemer and seconded by Commissioner Holland to recommend that City Council approv~ Kaltec of Minnesota, Inc.'s application for a temporary conditional use permit and declare terms of same. Case #4: Request for a Conditional Use Permit for an Accessory Apartment in the R-1 RUral Residential DistriCt; Case of Cathy Gustafson Zoning Administrator Frolik advised that Cathy Gustafson has applied for a conditional use permit to maintain an accessory apartment in her home at 15823 Nowthen Boulevard N.W. She stated that the main living quarters were constructed in 1963 and an addition was put on the home in 1974. Ms. Frolik explained that the addition is separated from the main living quarters by an atrium door and consists of kitchen, living room, bedroom, and bathroom, and is serviced by its own furnace, water heater and gas meter. Ms. Frolik informed that Ms..Gustafson disagrees with the need for a CUP because both units are occupied by family, neither unit is income producing, both units are served by the same septic system and well, and the accessory unit has been used as such since its construction in ~e 1970s and she continued that use when she took ownership in 1991. The Planning and Zoning Commission proceeded to review the Findings of Fact. It was the consensus of the Commission that #1 through #14 would remain as presented.
