Mayer's request for a variance to construct a four-season porch addition within the setback from <br />the Ordinary High Water mark at 9124 Collins Drive NW. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Brauer, Jeffrey, <br />Shepherd, Van Scoy, and Watson. Voting No: None. Absent: None. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Brauer to approve Mr. and Mrs. <br />Mayer's request for a variance at 9124 Collins Drive NW based on the Findings of Fact and <br />adopt Resolution #04-09-235 declaring terms of variance. <br /> <br />Board Member Van Scoy noted there is a letter from the hydrologist that indicated he would like <br />to have a statement added to the conditions putting homeowners on notice there would be no <br />further variances of this type. <br /> <br />Chairperson Nixt indicated his opinion is that the hydrologist was saying there would be no more <br />discretionary setbacks. He stated he thinks the appropriate way to handle future requests would <br />be to send the information to the DNR who could deny a recommendation for approval, which <br />would fulfill the hydrologist's request. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Brauer, Jeffrey, <br />Shepherd, Van Scoy, and Watson. Voting No: None. Absent: None. <br /> <br />Case #2 <br /> <br />Request for a Variance from Street Frontage or Lot Width Requirements; <br />Case of Kelly and Carrie Itemp <br /> <br />Presentation <br />Associate Planner Wald asked that this item be continued. <br /> <br />Public Hearing <br /> <br />Motion by Chairperson Nixt, seconded by Board Member Johnson to table the public hearing <br />until the October 7, 2004 Planning Commission meeting. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Brauer, Jeffrey, <br />Shepherd, Van Scoy, and Watson. Voting No: None. Absent: None. <br /> <br />Case #3 <br /> <br />Request for a Variance to Expand a Lawful Non-conforming Accessory <br />Structure that is Nearer the Front Property Line than the Home; Case of <br />Michael Mettler <br /> <br />Presentation <br /> <br />Community Development Director Frolik explained City Code states that for properties less than <br />two acres in size, accessory structures must either be located in the side or rear yard of the <br />property and may or may not be located nearer the front property line than the home.
