Councilmember introduced the following resolution and moved for its adoption: <br /> <br /> RESOLUTION #04- <br /> <br />A RESOLUTION WAIVING THE i4 DAY TIME FRAME REQUIREMENT BETWEEN <br />THE PLANNING COMMISSION PUBLIC HEARING AND CITY COUNCIL ACTION: <br /> <br /> WHEREAS, Kevin Block, Barbara Lee, and Gary Sandberg, hereinafter referred to as <br />"Applicants", have properly applied for amended conditional use permit approval on the property <br />generally known as 15823 Nowthen Blvd and legally described as follows: <br /> <br /> That part of the Southwest Quarter of the Southwest Quarter of Section 14, Township 32, <br />. Range 25, Anoka County Minnesota described as follows: Commencing at the Southeast <br />comer of said Southwest Quarter of the Southwest Quarter which point is the intersection <br />of the South line of said Section 14 with the centerline of County State Aid Highway No. <br />5; Thence North 0 degrees 36 minutes 25 seconds West along said Centerline a distance <br />of 224.10 feet; thence Northwesterly on a tangential curve to the left having a radius of <br />442.92 feet and having a delta angle of 37 degrees 57 minutes 15 seconds for a distance <br />of 293.40 feet; Thence North 38 degrees 33 minutes 40 seconds'West along said <br />centerline and tangent to said curve a distance of 447.0 feet to the actual point of <br />beginning of the tract of land to be hereby described; Thence continuing North 38 degr.ees <br />33 minutes 40 seconds West along said centerline a distance of 290.90 feet;. Thence North <br />69 degrees 40 minutes 20 seconds East to its intersection with the East line of said <br />Southwest Quarter of the Southwest Quarter; Thence Southerly along said East line to its <br />intersection with a line having a bearing of North 89 degrees 42 minutes 50 seconds East <br />and drawn from the actual point of beginning; Thence South 89 degrees 42 minutes 50 <br />seconds West a distance of 360 feet, more or less, to the actual point of beginning (for the <br />purpose of this description, the South line of said Section 14 is assumed to have a bearing <br />of East and West), Anoka County, MN <br /> <br />(the "Subject Property") <br /> <br /> WHEREAS, on September 21, 2004, the City of Ramsey received an application <br />requesting an amended conditional use permit to eliminate the owner occupancy requirement; <br />and <br /> <br /> WHEREAS, the Planning Commission held a regular Planning Commission meeting on. <br />October 7, 2004, 2004, held the required public hearing and reviewed the request; and <br /> <br /> WHEREAS, City Code states that conditional use permits must wait at least 14 days <br />following the Planning Commission'public hearing to be reviewed by the City Council; and <br /> <br /> WHEREAS, the Applicant has stated that a purchase agreement has been made with a <br />prospective buyer and is contingent on the outcome of the request; and <br /> <br /> <br />
