Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #04- A RESOLUTION WAIVING THE i4 DAY TIME FRAME REQUIREMENT BETWEEN THE PLANNING COMMISSION PUBLIC HEARING AND CITY COUNCIL ACTION: WHEREAS, Kevin Block, Barbara Lee, and Gary Sandberg, hereinafter referred to as "Applicants", have properly applied for amended conditional use permit approval on the property generally known as 15823 Nowthen Blvd and legally described as follows: That part of the Southwest Quarter of the Southwest Quarter of Section 14, Township 32, . Range 25, Anoka County Minnesota described as follows: Commencing at the Southeast comer of said Southwest Quarter of the Southwest Quarter which point is the intersection of the South line of said Section 14 with the centerline of County State Aid Highway No. 5; Thence North 0 degrees 36 minutes 25 seconds West along said Centerline a distance of 224.10 feet; thence Northwesterly on a tangential curve to the left having a radius of 442.92 feet and having a delta angle of 37 degrees 57 minutes 15 seconds for a distance of 293.40 feet; Thence North 38 degrees 33 minutes 40 seconds'West along said centerline and tangent to said curve a distance of 447.0 feet to the actual point of beginning of the tract of land to be hereby described; Thence continuing North 38 degr.ees 33 minutes 40 seconds West along said centerline a distance of 290.90 feet;. Thence North 69 degrees 40 minutes 20 seconds East to its intersection with the East line of said Southwest Quarter of the Southwest Quarter; Thence Southerly along said East line to its intersection with a line having a bearing of North 89 degrees 42 minutes 50 seconds East and drawn from the actual point of beginning; Thence South 89 degrees 42 minutes 50 seconds West a distance of 360 feet, more or less, to the actual point of beginning (for the purpose of this description, the South line of said Section 14 is assumed to have a bearing of East and West), Anoka County, MN (the "Subject Property") WHEREAS, on September 21, 2004, the City of Ramsey received an application requesting an amended conditional use permit to eliminate the owner occupancy requirement; and WHEREAS, the Planning Commission held a regular Planning Commission meeting on. October 7, 2004, 2004, held the required public hearing and reviewed the request; and WHEREAS, City Code states that conditional use permits must wait at least 14 days following the Planning Commission'public hearing to be reviewed by the City Council; and WHEREAS, the Applicant has stated that a purchase agreement has been made with a prospective buyer and is contingent on the outcome of the request; and
