Commissioner Van Scoy indicated one of the letters references a concern that the siding will not
be finished. He asked Staff to address this concern.

Community Development Director Frolik indicated City Code states you have one year to finish
the extension of a building.

Commissioner Van Scoy asked about Code compliance issues.

Community Development Director Frolik indicated that Mettler's case is open and being worked
on. Community Development Director Frolik also stated there is a term in the resolution
addressing the fact that no commercial operations may take place on the premises unless in
accordance with City Code.

Commissioner Johnson asked if the Commission has denied any requests of this nature in the
past.

Community Development Director Frolik indicated none of this size have been denied. She
noted Staff is reviewing the ordinance to see if the allotment for accessory structure size should
be adjusted.

Commissioner Brauer commented that he is glad Staff is looking at the size restrictions, but it
seems that many of these situations have messy yards, and he is concerned about the perception
that they are saying it is okay to build over-sized structures to clean up a mess that should not be
there in the first place. He stated he wonders if they need to examine that as a reason for adding
a structure.

Citizen Input

Chairperson Nixt opened the hearing for public comment at 7:29 p.m.

Motion by Commissioner Johnson, seconded by Commissioner Brauer to close the public
hearing at 7:30 p.m.

Motion carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Brauer, Jeffrey,
Shepherd, Van Scoy and Watson. Voting No: None. Absent: None.

Commission Input

Motion by Commissioner Johnson, seconded by Commissioner Van Scoy to recommend that the
City Council adopt findings of fact relating to Michael Mettler's request for a Conditional Use
Permit to exceed the allotted square footage for accessory buildings.

Further Discussion:

Planning Commission/September 2, 2004
