CASE # ADOPT ORDINANCE TO VACATE EASEMENT IN RAMSEY TOWN CENTER ADDITION; CASE OF RAMSEY TOWN CENTER LLC By: Sylvia Frolik, Community Development Director Background: As part of the development associated with Ramsey Town Center 3rd Addition, the drainage and utility easements on the underlying Outlot I, Ramsey Town Center, will need to be vacated. They will be replaced with new drainage and utility easements as part' of the new plat. The 'following items are enclosed for your information: a) b) c) Site location map Exhibit of underlying easements to be vacated Proposed Ordinance Notification: [n accordance with State Statute, City Staff attempted to notify property owners within 350 feet of the subject property of the July 27, 2004 public hearing to vacate easements. Observations: On July 27, 2004, the City Council introduced an ordinance to vacate the drainage and utility easement over Outlot I, Ramsey Town Center Addition. Final adoption of the ordinance was withheld until the final plat was submitted for approval to ensure that replacement easements were properly dedicated. The final plat is on tonight's agenda for approval and this ordinance is now eligible for adoption. Recommendation: City Staff recommends adoption of the ordinance. Council Action: Motion to adopt Ordinance #04-10-__ to vacate the drainage and utility easements contained on Outlot I, Ramsey Town Center Addition.
