Motion by Councihnember Cook, seconded by Councilmember Strommen, to introduce an <br />ordinance amending certain parts of those definitions contained within Section 5.08.02 of the <br />City Code, to be all-inclusive of the City zoning. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Strommen, Elvig, Kurak, <br />Pearson, and Zimmerman. Voting No: None. <br /> <br />Case #6: <br /> <br />Request for Extension to Variance from Rogers Lake Setback; Case of Brian <br />and Laurel Jones <br /> <br />Community Development Director Frolik advised in November of 2002, the Board of <br />Adjustment approved Ron Canner's request for a variance to the setback from the ordinary high <br />water mark of Rogers Lake. Mr. Canner was in the process of subdividing his property to create <br />a buildable lot for his daughter and son-in law. The variance was approved with a two-year time <br />frame in which to initiate the variance. They have not been able to pull a building permit yet, <br />and policy has been that application for building permit initiates the variance. Staff recommends <br />approval of the request for extension of the variance. <br /> <br />Motion by Councilmember Pearson, seconded by Councilmember Cook, to adopt Resolution <br />#04-09-302 extending deadline for initiating the variance to the Rogers Lake Setback in L.P. <br />Keillor Addition to November 7, 2005. <br /> <br />Motion carried. Voting Yes: Mayor Garnet, Councilmembers Pearson, Cook, Elvig, Kurak, <br />Strommen, and Zimmennan. Voting No: None. <br /> <br />Case #7: <br /> <br />Adopt Ordinance Vacating Underlying Drainage and Utility Easements in <br />Gateway North Industrial Park No. 5; Case of City of Ramsey and Basalt <br />Properties <br /> <br />Assistant Community Development Director Trudgeon stated the City Council recently approved <br />the final plat of Basalt Office Park 2nd Addition. The plat re-subdivided Lot 2, Block 1, Gateway <br />North Industrial Park No. 5, into two buildable lots. The City Council also approved site plans <br />for the development of office and warehouse multi-tenant buildings on the newly created lots. <br />The final plat for Basalt Office Park 2nd Addition will create new drainage and utility easements, <br />therefore, the existing drainage and utility easements must be vacated. <br /> <br />Motion by Councihnember Cook, seconded by Councilmember Elvig, to adopt Ordinance #04- <br />40 to vacate underlying drainage and utility easements on Lot 2, Block 1, Gateway North <br />Industrial Park No. 5. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Elvig, Kurak, Pearson, <br />Strommen, and Zimmerman.
