Motion by Councihnember Cook, seconded by Councilmember Strommen, to introduce an ordinance amending certain parts of those definitions contained within Section 5.08.02 of the City Code, to be all-inclusive of the City zoning. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Strommen, Elvig, Kurak, Pearson, and Zimmerman. Voting No: None. Case #6: Request for Extension to Variance from Rogers Lake Setback; Case of Brian and Laurel Jones Community Development Director Frolik advised in November of 2002, the Board of Adjustment approved Ron Canner's request for a variance to the setback from the ordinary high water mark of Rogers Lake. Mr. Canner was in the process of subdividing his property to create a buildable lot for his daughter and son-in law. The variance was approved with a two-year time frame in which to initiate the variance. They have not been able to pull a building permit yet, and policy has been that application for building permit initiates the variance. Staff recommends approval of the request for extension of the variance. Motion by Councilmember Pearson, seconded by Councilmember Cook, to adopt Resolution #04-09-302 extending deadline for initiating the variance to the Rogers Lake Setback in L.P. Keillor Addition to November 7, 2005. Motion carried. Voting Yes: Mayor Garnet, Councilmembers Pearson, Cook, Elvig, Kurak, Strommen, and Zimmennan. Voting No: None. Case #7: Adopt Ordinance Vacating Underlying Drainage and Utility Easements in Gateway North Industrial Park No. 5; Case of City of Ramsey and Basalt Properties Assistant Community Development Director Trudgeon stated the City Council recently approved the final plat of Basalt Office Park 2nd Addition. The plat re-subdivided Lot 2, Block 1, Gateway North Industrial Park No. 5, into two buildable lots. The City Council also approved site plans for the development of office and warehouse multi-tenant buildings on the newly created lots. The final plat for Basalt Office Park 2nd Addition will create new drainage and utility easements, therefore, the existing drainage and utility easements must be vacated. Motion by Councihnember Cook, seconded by Councilmember Elvig, to adopt Ordinance #04- 40 to vacate underlying drainage and utility easements on Lot 2, Block 1, Gateway North Industrial Park No. 5. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Elvig, Kurak, Pearson, Strommen, and Zimmerman. Voting No: None.
