With this situation there will not be concerns of appeals to the assessments. <br />There is still discussion as to how to put the assessment agreements in place. He explained <br />Phase 2 street improvements will need to be moved on immediately as part of the assessment <br />hearings. At this time the developer is considering the possibility of Item No. 14 of' the Master <br />Development Agreement being removed in exchange for Item 37(e), which relates to parking <br />ramps and the developer sharing in the savings. They were having such a difficult time trying to <br />put Item 37(e) into legal language that he suggested these items be swapped. The developer is <br />considering that at this time. <br /> <br />Councihncmber Elvig noted a special taxing district is a guarantee of funds, while the gq'ants may <br />not be. He stated he is uncomfortable giving away any assessments, especially since the Public <br />Works Committee just discussed that there will be a need for a snow removal site. <br /> <br />City Administrator Norman explained item #14 is new in the agreement. This came into the <br />master agrecment when the Council directed staff to change the park agreement and take out that <br />$1,500 per building permit. The amount that would be received in the grant is roughly the same <br />alnotlllt. <br /> <br />Councihnember Cook stated he thinks it is time to give up the $1,500 per building permit and <br />lllove o11. <br /> <br />Councihnember Kurak stated the City should be watchful of the amount of money being spent on <br />the attorney and the amount of time in negotiations, as the City is paying for the attorney's time. <br /> <br />City Administrator Norman indicated this is not in negotiations any longer, they are just trying to <br />get the agreement into final language. <br /> <br />Councihnember Kurak requested a summary of the attorney's charges. <br /> <br />City Administrator Norman explained by the time the City receives the billing there is almost a <br />two-month lag. He would rather not pull the attorney off his work on the agreement at this time. <br /> <br />Mayor Gamec stated this is a big project and it is important to be sure the City is protected on <br />this.
