Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #03-06-148 <br /> <br />RESOLUTION AUTHORIZING THE PREPARATION OF A FEASIBILITY STUDY <br /> <br /> WHEREAS, OAKWOOD LAND DEVELOPMENT, INC, and JOHN ROWE, <br />("LANDOWNERS") have petitioned the CITY OF RAMSEY ("CITY") for the extension of urban <br />services to certain areas of the CITY identified on the attached map ("Subject Areas"); and <br /> <br /> WHEREAS, the CITY'S Comprehensive Plan identifies the Subject Areas proposed by the <br />LANDOWNERS to be served with municipal utilities as "Rural Developing" and "Central Reserve <br />Area"; and <br /> <br /> WHEREAS, the CITY'S Comprehensive Plan declares that the extension of urban services to <br />its land areas designated "Rural Developing" and "Central Reserve Area" is not practical or financially <br />fcasible; and <br /> <br /> WHEREAS, notwithstanding the CITY'S Comprehensive Plan designation of the Subject <br />Areas with urban services, the LANDOWNERS request that the CITY authorize a Feasibility Study to <br />determine the feasibility of serving the Subject Areas with urban services; and <br /> <br /> WHEREAS, the CITY has significant reservations with the LANDOWNERS' proposal for <br />extension of urban services to the Subject Areas; and <br /> <br /> WHEREAS, notwithstanding the CITY'S significant reservation the LANDOWNERS <br />continue to request that the CITY authorize a Feasibility Study. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the CITY authorizes the engineering firm ofBolten & Menk to prepare a Feasibility Study <br />to determine the feasibility of the CITY extending urban services to the Subject Area <br />contingent upon the following conditions: <br /> <br />a) <br /> <br />b) <br /> <br />c) <br /> <br />That the LANDOWNERS pay all expenses of Bolten & Menk in preparing the <br />Feasibility Study. <br />That prior to the CITY directing Bolten & Menk to perform the Feasibility Study, the <br />LANDOWNERS shall deposit with the CITY the sum of $14,050.00 cash which <br />amount is 125% of estimated cost of the Feasibility Study (the "Escrow Account"). In <br />addition, the Landowner shall agree to reimburse the City for its administrative <br />expenses in overseeing the preparation of the feasibility study. <br />The terms of the Escrow Account shall permit the CITY to draw upon it to pay all City <br />administrative expenses and including Bolten & Menk's fees for the preparation of the <br />Feasibility Study. From the Escrow Account any funds not necessary for payment of the <br />Feasibility Study and administrative expenses shall be returned to Landowners within <br />60 days of the City's receipt of the completed Feasibility Study. <br /> <br />RESOLUTION # 03-06-148 <br /> Page 1 of 2 <br /> <br /> <br />
