Absent: Commissioners Johnson, Sweet, and Watson. <br /> <br />NOTE CITY COUNCIL MINUTES <br /> <br />1) City Council regular meeting minutes dated March 26, 2002 <br />2) City Council regular meeting minutes dated April 9, 2002 <br />3) City Council regular meeting minutes dated April 23, 2002 <br /> <br />PUBLIC HEARINGS/COMMISSION BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Conditional Use Permit to Expand a Lawful Nonconforming <br />Ready-Mix Plant to Include a Second Silo; Case of Marshall Concrete <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 8:58 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 8:58 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik explained Marshall Concrete is a lawful <br />nonconforming concrete ready-mix plant located at 14141 Unity Street N.W. The company has <br />determined that their operation is in need of a second product silo. According to City Code, any <br />enlargement or expansion of a lawful nonconforming use must be done so in accordance with <br />City Code. Therefore, Marshall Concrete has applied for a conditional use permit for the <br />addition of the second silo. It is reasonable to assume that the volume of traffic and activity will <br />increase with the addition of the second silo. The Public Works Department has advised that the <br />tracking of dirt onto 140th Avenue from traffic entering and exiting the property is an issue that <br />should be addressed. Also, upon a site inspection it became apparent that the existing berm and <br />landscape screening adjacent to 140~ Avenue has significantly deteriorated. She noted City Staff <br />is recommending approval of the addition of the second silo with the following contingencies: <br /> · That the Applicant provide 100 foot paved approaches at both accesses onto 140t~ Avenue <br /> N.W. to reduce the amount of materials being tracked onto the public street. <br /> · That the Applicant be required to replace dead and dying trees adjacent to 140~ and re- <br /> establish the turf by August 1, 2002. <br /> · That the Applicant submit a 140th Avenue screening plan to the City for review and <br /> approval by August 1, 2002. <br /> · That the Applicant be required to install the approved screening by November 1, 2002. <br /> · Board of Adjustment approval of the variance to height restrictions on the silo. <br /> <br />Planning Commission/June 6, 2002 <br /> Page 2 of 15 <br /> <br /> <br />
