The company has
determined that their operation is in need of a second product silo. According to City Code, any
enlargement or expansion of a lawful nonconforming use must be done so in accordance with
City Code. Therefore, Marshall Concrete has applied for a conditional use permit for the
addition of the second silo. It is reasonable to assume that the volume of traffic and activity will
increase with the addition of the second silo. The Public Works Department has advised that the
tracking of dirt onto 140th Avenue from traffic entering and exiting the property is an issue that
should be addressed. Also, upon a site inspection it became apparent that the existing berm and
landscape screening adjacent to 140~ Avenue has significantly deteriorated. She noted City Staff
is recommending approval of the addition of the second silo with the following contingencies:
· That the Applicant provide 100 foot paved approaches at both accesses onto 140t~ Avenue
N.W. to reduce the amount of materials being tracked onto the public street.
· That the Applicant be required to replace dead and dying trees adjacent to 140~ and re-
establish the turf by August 1, 2002.
· That the Applicant submit a 140th Avenue screening plan to the City for review and
approval by August 1, 2002.
· That the Applicant be required to install the approved screening by November 1, 2002.
· Board of Adjustment approval of the variance to height restrictions on the silo.

Planning Commission/June 6, 2002
