1) That the applicant has properly applied for a conditional use permit <br />as required by ordinance to operate and maintain a taxidermist shop. <br /> <br />2) That the applicant appeared before' the Planning and Zoning Commission <br />for a public hearing pursuant to City Zoning Ordinance on January 5, 1982. <br />That said public hearing was properly advertized and that the minuts of <br />said public hearing are hereby incorporated by reference. <br /> <br />3) That the Standards for Consideration are as follows: <br /> <br />a) The property is zoned R-1 and this is not a permitted <br /> use. <br /> <br />b) The adjoining properties are residential dwellings <br /> located on approximately one acre parcels. <br /> <br />c) The closest similar use is within a distance of approxi- <br /> mately three (3) miles. <br /> <br />d) There will be no adverse effect to traffic flow in the <br /> area. <br /> <br />e) There is one (1) known taxidermist shop in operation <br /> within the City which is located in B-1 zoning. <br /> <br />f) <br /> <br />Properly maintained, the taxidermist shop will not <br />affect the life style of the neighboring residents in a <br />residential setting. Further, it should not affect the <br />enjoyment or value of properties in the vicinity. <br /> <br />4) That the Criteria for Approval/Disapproval are as follows: <br /> <br />a) <br /> <br />That the taxidermist shop maintenance and operation will <br />not be detrimental to or endanger the public health, <br />safety and general welfare and is not contrary to es- <br />tablished standards, regulations or ordinance of other <br />governmental agencies. <br /> <br />b) <br /> <br />That the use will not be substantially injurious to the <br />permitted uses nor unduly restrict the enjoyment of other <br />property in the immediate vicinity nor substantially <br />diminish and impair property values within the area. <br /> <br />c) <br /> <br />That the establishment of the use will not impede the <br />orderly and normal development and 'improvement of the <br />surrQunding property for uses permitted in the zoning <br />district. <br /> <br />d) <br /> <br />That adequate water supply and sewage disposal facilities <br />are provided or shall be provided in accordance with <br />applicable standards. <br /> <br /> <br />
