City Staff has determined that the homeowner responsible for constructing the <br />acee,ssory'apartment in the 1970's never properly obtained a conditional use permit in <br />accordance with City Code and therefore the accessory apartment is considered illegal non- <br />conforming. <br /> <br />Thatlhe main living quarters and accessory apartment were damaged by f~re in 1993 and <br />upon!inspection by City Staff, the Applicant was informed that a conditional use permit <br />mustibe obtained to bring the accessory apmiment into compliance with City Code. <br /> <br />That the Applicant has submitted a petition signed by four (4) neighboring residents <br />indicating no objection to the aclded living quarters.. <br /> <br />That there are other similar permitted conditional uses in the single family district. <br /> <br />That the proposed use will not adversely impact traffic in the area. <br /> <br />That the proposed use will not be dangerous or detrimental to persons residing or working <br /> <br />That the proposed use will not substantially or adversely impair the use, enjoyment or <br />market value of surrounding properties. <br /> <br />That the proposed use will be maintained in order to be harmonious in appearance with the <br />existing and intended character of the R-1 Rural Residential District. <br /> <br />That the proposed use will be adequately served by essential public services. <br /> <br />That the proposed use will not create excessive additional requirements at public cost for <br />public, facilities and services.
