CouncilmemberZimmennan introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #94-02-041 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A <br />PERMIT' FOR AN ACCESSORY APARTMENT IN <br />STRUCTURE IN THE R-I RURAL RESIDENTIAL <br /> <br />CONDITIONAL USE <br />A SINGLE FAMILY <br /> <br /> WHEREAS, Cathy Gustafson has properly applied for a conditional use permit <br />("Permit") to rn~intain an accessory apartment Within the single family dwelling in the R~I Rural <br />Residential District on the property generally known as 15823 Nowthen Blvd. N.W. and.legally <br />described as ;follows: <br /> <br /> That part of the Southwest Quarter of the Southwest Quarter of SectiOn 14, Township 32, <br /> Range 25, Anoka County Minnesota described as follows: Commencing at the Southeast. <br /> comer of said Southwest Quarter of the Southwest Quarter which point is the intersection <br /> of the South line of said Section 14 with the eenterline of County State Aid Highway No. <br /> 5; Thence North 0 degrees 36 minutes 25 seconds West along said Cemerline a distance of <br /> 224.10 feet; thence Northwesterly on a tangential curve to the left having a radius of <br /> 442.92 feet and having a delta angle of 37 degrees 57 minutes 15 seconds for a distance of <br /> 293.40 feet; Thence North 38 degrees 33 minutes 40 seconds West along.sa.id centerline <br /> and !angent to said curve a dismce of 447.0 feet to the actual point of beginning of the tract <br /> of land to be hereby described; Thence continuing North 38 degrees 33 minutes 40 seconds <br /> West,along said centerline a distance of 290.90 feet; Thence North 69 degrees 40 minutes <br /> 20 seconds East to its intersection with the East line of said Southwest Quarter of the <br /> Southwest Quarter; Thence Southerly along said East' line to its intersection with a line <br /> having a bearing of North 89 degrees 42 minutes 50 seconds East and draWn from the <br /> actual point of beginning; Thence South 89 de .grees 42 minutes 50 seconds West a distance ' <br /> of 360 feet, more or less, to the actual point of beginning (for the purpose of this <br /> description, the South line of said Section 14 is assumed to have a bearing of East and <br /> West.) <br /> <br /> WHEREAS, the Planning Commission met on February 1, I994, conducted the public <br />he, ring and recommended City Council approval of the request. <br /> <br /> NOW TItEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Based on Findings of Fact #~)354, a conditional use permit (the "Permit") for an accessory <br /> aparln3ent within the single family dwelling unit is hereby granted to Cathy Gustafson, (the <br /> "Perrrdt Holder"), at 15823 Nowthen Blvd. N.W. (the "Subject Property"). <br /> <br />2. That said Permit shall remain in effect so long as the conditions imposed herein are <br /> comp.lied with and the property owner maintains residence in one of the two units on the <br /> Subject Property. <br /> <br />That the structure exterior shall maintain the appearance of a single family dwell/ng mit. <br /> <br />That the structure shall 'not be further altered to render it marketable as a duplex or the <br />acce.ss0ry apartment as a condominium. <br /> <br />That the accessory apartment shall be restricted to a two (2) bedrOOm unit and iS ~pproved <br />for occui~a~acy by a maximum of four (4) persons. <br /> <br />That all occupants of the dwelling and accessory apartment shall be provided with off-street <br />parking. <br /> <br /> <br />
