Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #0g- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FOR AN AMENDED CONDITIONAL USE PERMIT TO ALLOW AN <br />ACCESSORY APARTMENT IN A SINGLE FAMILY STRUCTURE 'IN THE R-1 <br />RESIDENTIAL DISTRICT <br /> <br /> WHEREAS, Kevin Block, Barbara Lee, and Gary Sandberg, hereinafter'referred to as <br />"Applicants", have properly applied for an amended Conditional Use Permit to allow an <br />accessory apartment in a single family structure in the R-1 Residential District on the property <br />generally .known as 15823 Nowthen Blvd. NW and legally described as follows: <br /> <br />That part of the Southwest Quarter of the Southwest Quarter of Section 14, Township 32, <br />Range 25, Anoka County Minnesota described as follows: Commencing at the Southeast <br />corner of said Southwest Quarter of the Southwest Quarter which point is the intersection <br />of the South line of said Section 14 with the centerline of County State Aid Highway No. <br />5; Thence North 0 degrees 36 minutes 25 seconds West along said Centerline a distance <br />o~' 224.10 feet; thence Northwesterly on a tangential curVe to tl~e left having a radius of <br />442.92 feet and having a delta angle of 37 degrees 57 minutes 15 seconds for a distance <br />ot'293.40 feet; Thence North 38' degrees 33 minutes 40 seconds West along said <br />centerline and tangent to said curVe a distance of 447.0 feet to the actual point of <br />beginning of the tract of land to be hereby described; Thence continuing North 38 degrees <br />33 minutes 40 seconds West along said centerline a distance of 290:90 feet; Thence North <br />69 degrees 40 minutes 20 seconds East tO its intersection with the East line of said <br />Southwest Quarter of the Southwest Quarter; Thence Southerly along said East line to its <br />intersection with a line having a bearing of North 89 degrees 42 minutes 50 seconds East <br />and drawn from the actual point of beginning; Thence South 89 degrees 42 minutes 50 <br />seconds West a distance of 360 feet, more or less, to the actual point of beginning (for the <br />purpose of this description, the South line of said Section 14 is assumed to have a bearing <br />of East and West.) <br /> <br />(the "S ubject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as .follows: <br /> <br />That the Applicants appeared before the Planning CommissiOn for a public hearing <br />pursuant to Section 9.03.05 of the Ramsey City Code on October- 7, 2004, and that Said <br />public hearing was properly advertised and that the minutes of said public hearing 'are <br />hereby incorporated by reference. <br /> <br />2. That the Subject Property is zipproximately four (4) acres in size.' <br /> <br />3. That the subject property is located in the R-1 Residential - Rural Developing District. <br /> <br />That the surrounding parcels are zoned R-1 Residential - Rural Developing and that <br />accessory apartments are not currently permitted as a conditional use in this zoning district. <br /> <br /> <br />
