CASE # ADOPT ORDINANCE TO VACATE EASEMENT IN RAMSEY TOWN CENTER ADDITION; CASE OF RAMSEY TOWN CENTER LLC By: Sylvia Frolik, Community Development Director Background: As part of the development associated with Ramsey Town Center 3rd Addition, the drainage and utility easements on the underlying Outlot I, Ramsey Town Center, will need to be vacated. They will be replaced with new drainage and utility easements as part of the new plat. The following items are enclosed for your information: a) b) c) Site location map Exhibit of underlying easements to be vacated Proposed Ordinance Observations: On July 27, 2004, the City Council introduced an ordinance to vacate the drainage and utility easement over Outlot I, Ramsey Town Center Addition. Final adoption of the ordinance was withheld until the final plat was submitted for approval to ensure that replacement easements were properly dedicated. The final plat was approved on October 12, 2004. The final adoption of the easement vacation ordinance was tabled on October 12 because the City had not received a written commitment from Ramsey Town Center, LLC accepting responsibility for additional storm sewer costs resulting from vacating the existing easement. Recommendation: City Staff recommends adoption of the ordinance contingent upon receipt of the written commitment. Council Action: Motion to adopt Ordinance #04-10- to vacate the drainage and utility easements contained on Outlot I, Ramsey Town Center Addition.
