' a) 162nd Lane N.W. from the West line of the plat to its intersection with Germanium Street N.W. b) 164th Avenue N.W. from the West line of the plat to its intersection with Dysprosium Street N.W. c) Junkite Street N.W. from the North Boundary of Barthel's Rum River Acres 2nd Addition to its ~ntersection with 164th Avenue N.W. d) Germanium Street N.W. from its intersection with the North line of the plat South to the South line of the plat. e) 161st Lane N.W. from Germanium Street N.W. to Dysprosium Street N.W. That all of the said improvements shall be in accordance with the time table and plans and specifications therefor to be approved or prepareH by the City Engineer. 3) That the Developer, being the sole owner of Lots 2 through 12 of Block 6; Lot 2, Block 3; Lots 2 and 3, Block 5; Lots 2 and 3, Block 7; and Lot 2, Block 9 all in Barthel's Rum River Acres 2nd Addition hereby agrees to permit the City to assess pursuant to M.S.A. Chapter 429 $1,058.00 on each of said lots in return for these assessments the Developer's obligation to pave 164th Lane N.W. from Highway 47 to its intersection with the East line of Junkite Street N.W., which requirement was originally provided for in Paragraph 2) a) of the Performance Contract between the parties hereto~dated October 12, 1979 will not be required. This provision is entered into as the parties agree that the cost of paving said 164th Lane N.W. from ' Highway 47 to Junkite Street N.W. would be $18,000.00 (17 Lots x 1,058.00). 4) That I62nd Lane N.W. from Germanium Street N.W. to Dysprosium Street N.W. is unnecessary and the City agrees to commence a vacation procedure to have this portion of 162nd Lane N.W. vacated. 5) The Developer will not request and hereby waives any right to obtain building permits for any of the lots and blocks within 'Barthel's Rum River Acres 2nd
