i 11101 Iilll IIIII 0111 III1I IIIII 0111 IIII IIII <br />2173300. 002 Record ID 4029331 <br />Commissioner Brauer introduced the following resolution and moved for its adoption: ,1 <br />RESOLUTION #17-04-082 <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO THE SIDE <br />CORNER YARD SETBACK ON THE PROPERTY LOCATED AT 15359 ZUNI CT NW, <br />AND DECLARING TERMS OF SAME. <br />WHEREAS, Steve and Christine Roeder (Permittee), have properly applied for a variance <br />(the "Variance") from the side corner yard setback in the R-1 Residential (MUSA) District on the <br />property generally known as 15359 Zuni Ct and legally described as follows: <br />Lot 9, Block 1, Highlands at River Park 4th Addition, Anoka County, Minnesota <br />(the "Subject Property"); and <br />WHEREAS, the Planning Commission met on April 6, 2017, conducted the public hearing <br />and adopted findings of fact relating to the request for a variance from the corner side yard setback <br />requirements on the Subject Property. <br />NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br />1. Based on Findings of Fact #0979, a Variance to allow an accessory structure to remain in <br />its current location within the required corner side yard setback area on the Subject <br />Property is hereby granted contingent upon an approved drainage and utility easement <br />encroachment agreement being executed between the Applicant and the City. <br />2. That the accessory structure on the Subject Property shall maintain at a corner side yard <br />setback of six (6) feet from the public road right-of-way. <br />3. That the Permittee shall be responsible for obtaining a Zoning Permit for the existing, <br />detached accessory structure. <br />4. The Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br />The motion for the adoption of the foregoing resolution was duly seconded by Commissioner <br />Surma, and upon vote being taken thereon, the following voted in favor thereof: <br />Chairperson Bauer <br />Commissioner Brauer <br />Commissioner Surma <br />Commissioner Anderson <br />Commissioner Gengler <br />Commissioner Nosan <br />
