CHAPTER <br /> <br />Mum. ~lul <br /> <br />4(~2.3 j97 <br /> <br />4hZ.j J5 sul~d ~' <br /> <br />· The council adopts the mag by ordinance. <br /> <br />· The city files the ordinance and the official map with the county recorder. <br /> <br />An official map may show purposes For Future streets and sites for other <br />necessary public Facilities and services. The purpose of'the map is to permit <br />both private and publie'property owners to adjust building plans equitably <br />and conveniently bet'ore investments are made. <br /> <br />Affter a ma:}or thoroughfare plan and facilities are prepared by the planning <br />agency and recommended to the council, the agency may prepare and <br />recommend the official map. <br /> <br />Following the adoption and filing of an offi~'ial map. the issuance ofbuiiding <br />permits are subject to its provisions. If any building is built without a <br />building peri-nit or in violation oFpermit conditions, a municipally' does not <br />have to compensate a landowner whose building may be destroyed ifa s~reet <br />is widened. In other words~ while the official map does not give any interest <br />in land, it does authorize the municipality to acquire such interests in the <br />~'uture without having to pay compensation for buildings that are erected. <br /> <br />The board of adjustments and appeals is authorized to grant a building permit <br />upon finding that the entire property,' cannot otherwise yield a reasonable <br />return to the landowner and that a balancing of' interests requires granting the <br />permit. <br /> <br />Xlil. Interim uses <br /> <br />An interim use is a temporary use of property until a certain date or until the <br />use is no longer permitted. Authority tbr an interim use is fbund in the zoning <br />ordinances where conditions for the use are also specified. Typically, the <br />conditions will require the use to confbrm with the zoning code, a termination <br />date is certain, no additional costs to the public will be incurred, and the user <br />agrees to additional, reasonable conditions imposed by the council. <br /> <br />If a study is being conducted or has been authorized, if a hearing has been <br />heid or is scheduled for the purpose 'of considering adoption or amendment of <br />a comprehensive plan or zoning amendment, or if an annexation has <br />occurred, the council may adopt an interim ordinance to protect tiqe planning <br />process that regulates, restricts or prohibits any use. development or <br />subdivision tbr a period not to exceed one year t'rom the date it is effective. <br /> <br />103 <br /> <br /> <br />
