A person suing rD challenge a city's land use
actions when the action adversely operates on the person's rights of' property
or bears directly upon the person's personal interest. Specific injuries must be
alleged.

The general standard for review in all land use decisions is whether the
councii's action was reasonable and rationally based. If'the city neglects to ·
stare reasons for an ~ction taken on the record, the ride's action is presumed
arbitrary and unreasonable. Similariy. if the record contains no findings by
rim council the burden of proof'shifts rD the city to show its actions were
reasonable. Findings ~:tdopted within a reasonable rime are sufficient. For
example, in complex t,-narrers where additional time is required, findings
adopted at a subsequent council meedng may be appropriate, if' adopted
within r_he (50-day dine period as required by the 60-day ruie. Findings must
be ',egally sur'ficien[ and Gctuat}y supported.

When expiicit findings as to why a decision are made. dae courts respect the
broad discre, tion cities have to make routine municipal decisions and will
likely determine the decision is' nor arbitrary and capricious.

io-3z

106
