Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-11- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF'A CONDITIONAL USE PERMIT <br />TO RAMDANCE, LLC TO CONSTRUCT A BUILDING LARGER THAN 35,000 <br />SQUARE FEET IN THE TC-2 ZONING DISTRICT AND DECLARING TERMS OF <br />SAME: <br /> <br /> WHEREAS, Ramdance LLC, hereinafter referred to as the "Applicant," has properly <br />applied for a Conditional Use Permit to construct a building larger than 35,000 square feet in the <br />TC-2 Zoning District on property legally described as follows: <br /> <br />Outlot I, Ramsev Town Center Addition, Anoka County, Minnesota <br />(%ubject Propet~y") <br /> <br /> WHEREAS, the Planning Commission met on November 4, 2004, conducted the <br />public hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUkNCIL OF THE <br />CITY OF RAMSEY, ANOI. C4. COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That based on Findings of Fact #0__, a Conditional Use Permit (Permit) to construct a <br />building larger than 35,000 square feet in the TC-2 Zoning District, is hereby granted to <br />Ramdance, LLC, hereinafter referred to as the "Permittee". <br /> <br />That this Permit shall only apply to the ~ocery store building to be located on the Subject <br />Property, which [s proposed to be platted as Lot l, Block 1, Ramsey Town Center 3~d <br />Addition. <br /> <br />That in accordance with the final site plan approved by City Council on October 12, .2004, <br />this Permit shall allow for the initial development of a 62,000 square toot grocery store <br />building. <br /> <br />4. That this Permit shall also allow for future expansions of the grocery store and the maximum <br /> building size (~'ootprint) is established at 70,000 square feet. <br /> <br />5. That any future expansions of the grocery store building are subject to site plan approval from <br /> the City Council. <br /> <br />That the groceL'y store building shall be properly constructed and maintained in accordance <br />with all app'iicable Staff Review letters, approved site plans, City Code, and Uniform <br />Building Codes. <br /> <br />8 <br /> <br /> <br />
