City Attorney Goodrich replied a bank attorney is reviewing that. It cannot be requested at this
time because of the bank petition, and the bankruptcy has not been discharged. Perhaps the new
company will be willing to do this, but they would not be obligated.

Councih.nember E}vig stated this 1-nay be an opportunity, for the City to push its hand on this
issue. He asked if it could be suggested that the City is in acceptance of this, but all liabilities to
the City should be paid also. _

City Attorney Goodrich explained this agreement will pay the City back; it is not a benefit to
Vision-Ease or the new entity:

Mayor Gamec stated the TIF investment is far more important than the money fFO1TI the utilities.

Councilmember Elvig requested the collection of this payment be attempted.

Councilmember Cook suggested the collection be attempted after this a~'eement is approved.

City Attorney Goodrich indicated the City has received some correspondence from the company
purchasing Vision-Ease and they seem cordial and happy to come to RamseS/. Perhaps this
would be an avenue for communication.

Motion by Councilmember Elvig, seconded by Councilmember Cook, to direct staffto enter into
an assumption agreement to transfer Development A~eement from Vis/on-Ease Lens, Inc. to
Insight Equity. A.P.X, LP, a Texas Limited Partnership.

Motion can-ied. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Kurak, Pearson,
Strommen, and Zimmerman. Voting No: None.

Case #10:

Refer Citizen Petition Concerning Speed Limit on Baugh Street to Anoka
Count)., Public Works Committee for Consideration

Assistant Public Works Director Olson indicated last week the City received a petition fro1Tl
residents along Baugh Street requesting that the speed limit be reduced to 35 rnph from 55 mph.
There was a lot of discussion at the Public Works Committee and they felt it would be best to try
to process this petition as quickly as possible, rather than waiting for the report of the Public
Works Committee. The recommendation of the Public Works Committee was to forward the
petition on to the Anoka County Public Works Committee for consideration at the earliest
possible opportunity.

Motion by Councihnember Elvig, seconded by Councilmember Zimmennan, to adopt Resolution
#04~09-303 requesting that the Anoka County Public Works Committee consider the citizen
petit/on requesting the lowering of the speed limit on the subject se~nent of CR83 at the earliest
possible opportunity.

City..
