CASE # REQUEST FOR AN AMENDED CONDITIONAL USE PERMIT TO CONSTRUCT A BUILDING LARGER THAN 35,000 SQUARE FEET IN THE TC-2 ZONING DISRICT; CASE OF RAMDANCE, LLC By: Sylvia Frolik, Community Development Director Background: The TC-2 Zoning District restricts building sizes to 35,000 square feet; anything larger than that requires a Conditional Use Permit. On July 12, 2004, the Planning Commission conducted a public hearing and recommended City Council approval of Ramdance's proposal to construct a 54,000 square foot Coborn's grocery store in the proposed plat of Ramsey Town Center 3rd Addition. The Permit issued also recognized the possibility for future expansions and Set a maximum building size of 63,000 square feet. No ti fica tion: In accordance with State statute, Staff attempted to noti~ owners of property within 350 feet of the Subject Property of the applicant's request and the public hearing for an amendment to the previously issued conditional use permit. Observations: Subsequent to approval of the Conditional Use Permit for a building larger than 35,000 square feet, the Applicants submitted the final site plan to City Council for approval. The final site plan proposed to increase the initial size of the Coborn's =o'rocery store from 54,000 square feet to 62,000 square feet. The City Council granted final site plan approval of the Coborn's store as the current Conditional Use Permit allows a building size of up to 63,000 square feet. However, the Appli'cants have indicated the potential for the C0born's store to expand to 70,000 square ~'eet in the f'umre. Increasing the ultimate size of the building from 63,000 square feet to 70,000 square feet requires an amendment to the Conditional Use Permit issued in July.
