CASE

PUBLIC HEARING
REQUEST TO REZONE CERTAIN PROPERTY
FROM R-2 MEDIUM DENSITY RESIDENTIAL TO TOWN CENTER-4A;.
CASE OF BRIGHTKEYS, INC.
By: Amy Geisler, Associate Planner ·

Background:

Brightkeys, Inc. has requested that the City consider rezoning a portion of their property from R-
2 Medium Density Residential to Town Center - 4a in order to allow for a subdivision of their
land.

The following items are enclosed for your information:

a') Site location map
b) Sketch plan of Town Center Gardens 3~d Addition
c) Proposed Findings of Fact

Notification:

State statute requires that property o~vners within 350 feet of the subject property, be notified of
the public hearing. Notice was sent out to property owners within 700 feet of the Subject
Property.

Observations:

As discussed in the previous Comprehensive Plan Amendment case, the applicant has submitted
a revised sketch plan based on input received at the August 5, 2004 Planning Commission
meeting. The revised sketch plan shows the area under consideration for the rezoning to be
compatible with the adjacent Town Center development in both design and density. In order for
this to occur, a Comprehensive Plan Amendment to change the subject property's land use
coupled with a rezoning to Town Center 4a (TC-4a) is necessary. The TC-4a Zoning District
allows Lip to 10 residential units per acre.

Recommendation:

Because of the revisions that have been made to the Town Center Gardens 3rd Addition sketch
plan, and the cun-ent and p[mmed land use designation on adjacent properties, Staff recommends
approval of the rezoning request from R-2 to TC-4a.

45
