Counc ihnember introduced the following resolution.and moved for its adoption: <br /> RESOLUTION #04-11- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # TO REZONE CERTAIN <br />PROPERTY FROM R-2 MEDIUM DENSITY RESIDENTIAL TO TC-4a TOWN <br />CENTER <br /> <br /> WHEREAS, on October __, 2004, the City received an application to rezone certain <br />property in accordance with Section 9.03.03 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOI, Ck COUNTY, STATE. OF MINNESOTA, as follows: <br /> <br /> i. That Brightkeys, [nc, hereinafter referred to as "Applicant," has property applied to <br /> rezone certain property from P-,-2 Medium Density Residential.to TC-4a Town Center. <br /> <br /> 2. That the Planning Commission conducted a public hearing pursuant to Section 9.0_3.0.3 of <br /> the City Code on November 4, 2004 and said public hearing was properly advertised, and <br /> the minutes of said public hearing are hereby incorporated by reference. <br /> <br /> 3. That the property proposed to be rezoned is legally described as follows: <br /> <br /> 4. That the area of the property, to be rezoned is approximately 14.8 acres in size. <br /> <br /> 5. That the Subject Property is currently zoned R-2 Medium Density. Residential and is <br /> located within the boundaries of the current Metropolitan Urban Service Area (MUSA). <br /> <br /> 6. That the Comprehensive Plan designates the property for Medium Density, Residential <br /> development. <br /> <br /> 7. That the Applicant has submitted a Comprehensive Plan Amendment to change the land <br /> use designation in the Cgmprehensive Plan to Mixed Use. <br /> <br /> 8. That the proposed zoning amendment will/will not substantially adversely impair the use <br /> or market value of any surrounding property. <br /> <br /> 9, That the proposed zoning amendment will/will not change the essential character of the <br /> area, which is commercial. <br /> <br /> 10. That the existing road infl-astructure will/will not be capable of accommodating, in a sale <br /> manner, the additional traffic to be generated by the rezoned property. <br /> <br /> t 1.
