CONTI?UATION OF PUBLIC ttEARING <br /> REQUEST TO REZONE CERTAIN PROPERTY <br />FROM R-2 MEDIUM DENSITY RESIDENTIAL TO B-1 BUSINESS; <br /> CASE OF ARTHUR AND ELIZABETH R_AUDIO <br /> By: Sylvia Frolik, Community Development Director '- <br /> <br />Background: <br /> <br />CASE <br /> <br />As you may recall, on September 2, 2004, the Planning Commission conducted public hearings <br />regarding Arthur and Elizabeth Raudio's request for a Comprehensive Plan Amendment and a <br />rezoning to reclassify their property back to B-I Business from R-2 Residential. The subject <br />property is Outlot E, River's Bend 3rd Addition. <br /> <br />Notification: <br /> <br />State statute requires that property owners within 350 feet of the subject property.be notified of <br />the September 2nd public hearing.. <br /> <br />Observations: <br /> <br />On September 2. 2004, the Planning Commission adjourned the public hearing related to the <br />Comprehensive P[an amendment and continued any action or/ the request until the special <br />meeting scheduled for September 16. The public hearing relating to the rezoning request was <br />continued to September 16, at which time the applicant was to provide additional infbrmation. <br />Mr. Raudio was not prepared to go to the September 16 Special Planning Commission meeting <br />and his requests were scheduled on the regular October Planning Commission agenda. At the <br />October meeting, it was reported that Staff had not received any further direction from Mr. <br />Raudio. The Commission continued the rezoning public hearing to the November agenda, along <br />with the pending request for a comprehensive plan amendment. City Staff has not received any <br />additional in~tbrrnation from the Mr. Raudio. <br /> <br />Recommendation: <br /> <br />City Staff recommends adjourning the rezoning public hearing. Staff has implemented a 60 day <br />extension to the 60 clay rule and the Ci~ has until January. 1, 2005 to take formal action on Mr. <br />Raudio's request tbr a comprehensive plan amendment and a rezoning of Outlot E, River's Bend <br />3~d Adciition. <br /> <br />Commission Action: <br /> <br />Motion: by and seconded by to adjourn the public hearing relating to Mr. <br />R.audio's request rbr a rezoning of Outlot E, River's Bend 3~ Addition. <br /> <br />Reviewed by: <br />:\sst.
