A citizen cannot obtain a vested right in the zoning of their <br />prope~y. <br /> <br />Generally soeaking the courts seem to allow a rezoning after an application <br />for a pemlit has been made if'there [las been no action on the application <br />before the rezonlnz occurs. Because a rezoning is not effective unless the <br />proper procedure is fbi]owed, care should be taken not to violate the 60-day <br />rule wilen rezoning a parcel of property after a completed application i:or a <br />council action (conditional use permit, vadane& etc') has been made. <br /> <br />When properb' is rezoned from residentia! to commercial or industrial, a .m/o- <br />thirds rnajori~ of tile city. council is required. For other rezoning, a simple <br />majority is all that is required. The atiomey general is of tile opinion that <br />neither a charter nor an ordinance may increase this voting requiremenL <br /> <br />C. Extra-territorial zoning powers <br /> <br />A ciLv's zoning authodT may be extended to unincorporated territories <br />within two miles of its boundary, unless that area f~lls widqn another city, <br />county or township that has adopted zoning regulations.
