A municipality' must not enact, amend or enforce an <br />ordinance providing for the eiiminarion or termination ora use by <br />amortization for a use ,,vinicia use was lawful ar-the rime of' its inception. Bur any such restrictions on <br />nonconGnnities are specifically limited by state statute. <br /> <br />Any noncont'ormiries, including dqe lawful use or occupation of'land or <br />premises existing at flae dine of~:m amendment ro the zoning 6rdinance, may <br />be continued [brough repair, repiacemen[, restoration, maintenance. <br />improvement, bur not including expansion, unless: <br /> <br />(I) The nonconformity or occnpancy is discontinued for a period of more <br />chart one .,/ear; or <br /> <br />(2) .Any nonconi'orming use is destroyed bv fire or other peril to tl~e extent of' <br />greater than 50 percent of its market value, and no building permit has been <br />applied for within 180 days of when the property is damaged, in this case a <br />municipality may impose reasonable conditions upon a building permit in <br />order to mitigate any newly created impact on adjacent property. <br /> <br />Any subsequent use or occupancy oi:the land or premises shall be a <br />conforming ,.[se or occupancy. A municipality may. by ordinance, permit an <br />expansion or impose reasonable reguiarions ro prevent and aba[e nuisances <br />and ro protect rtne public health, welfare or sa~ry. The stature does nor <br />prohibit 3 municipalirs, fi'om enibrcing an ordinance that applies to adults- <br />only bookstores, adults-only theaters or simiiar adults-only businesses, as <br />defined by ordinance. " <br /> <br />Notwithstanding statutory restrictions on nonconformities.
