CITY OF PJ~SEY CITY COUNCIL FINDINGS OF FACT re Diane Shaefbauer CONDITIONAL USE PEP~IT l) That tt~e applicant has properly applied for a conditional use permit as required by ordinance to operate and maintain a beauty shop. That the applicant appeared before the Planning and Zoning Commission for a public hearing pursuant to City Zoning Ordinance on March 3, 1980. ~at said public hearing was properly advertized and that the ~l]nutes of said public hearing are hereby incorporated by reference. 3) That the Standards for Consideration are as follows: a) The property is zoned R-1 and this is not a permitted use. b) The adjoining properties are residential dwellings located on appro×imately one acre parcels. c) The closest similar use is within a distance of approximately two (2) miles. d) There will be no adverse affect to traffic flow in the area. e) There are three (3) knov~beauty shops in operation within the City which to our knowledge have not caused neighborhood problems. f) Properly maintained, the beauty shop will not affect the life style of the neighboring residents in a residential setting, Further, it should not affect the enjoyment or value of properties in the vicinity. 4) That t~e Criteria for Approval/Disapproval are as follows: a) The applicants request, to be the sole operator of a beauty shop, ~bo~Id not be detrimental to or endanger the public health, safety or g~nera]_ welfare and is not contrary to established stmndards as regulated by City Codes. The applicants proposed beauty shop has been inspected by the local building official and said report is hereby incorporated as a part of these findings. e) ~le lot size and proposed beauty shop location shouted not be ~- si%ety or undesirable or obnoxious in appearance mhd should not hinder the orderly and harmonious development of the City or the district where herein proposed.
