ARTICLE 37. Compensation and Employer's Liability Insurance <br />The Contractor shall maintain during the life of this Agreement the statutory Worker's Compensation, <br />in addition to, Employer's Liability Insurance in an amount not less than $100,000 for each <br />occurrence and a combined single limit of liability of $1,000,000 for each occurrence for all of his <br />employees to be engaged in Work on the Project under this Agreement and, in case any such Work is <br />sublet, the Contractor shall require the Subcontractor similarly to provide Worker's Compensation <br />and Employer's Liability Insurance for all of the latter's employees to be engaged in such Work. <br />Where Work under this Agreement includes any water or navigational exposure, coverage shall be <br />included to cover the Federal Longshoremen's and Harborworker's Act and the Federal Jones Act. <br />ARTICLE 38. Public Liability (including Automotive) and Property Damage Insurance <br />38.1 The Contractor shall maintain during the life of this Agreement such public liability and <br />property damage insurance and automobile public liability and property damage insurance and shall <br />protect him, the Owner, the Engineer, and any Subcontractor performing Work covered by this <br />Agreement from claims for damages for personal injury, including accidental death, as well as from <br />claims for property damage, which may arise from negligent operations under this Agreement, <br />whether such operations are by himself or by any Subcontractor or by anyone directly or indirectly <br />employed by either of them, and the amounts of such insurance shall be not less than: <br />(1) Public liability insurance in an amount not less than $500,000 for injuries, including wrongful <br />death to any one person, and subject to the same limit for each person in an amount not less than <br />$1,000,000 for each occurrence. <br />(2) "Broad Form" property damage liability insurance in an amount not less than $500,000 for <br />each occurrence. <br />38.2 The Contractor's public liability insurance and property damage insurance shall provide the <br />primary coverage on all claims arising out of the performance of the Agreement, and shall name the <br />Owner, its officers, agents and employees, and the Engineer as additional insureds therein. <br />ARTICLE 39. Insurance Coverage for Special Conditions <br />When the construction is to be accomplished within a public or private right-of-way requiring <br />insurance coverage, the Contractor shall conform to the particular requirements and provide the <br />required insurance. The Contractor shall include in his liability policy all endorsements that the said <br />authority may require for the protection of the authority, its officers, agents and employees. <br />Insurance coverage for special conditions, when required, shall be provided as set forth in the Special <br />Provisions. <br />ARTICLE 40. Cleaning Up <br />The Contractor will keep the premises free from accumulations of waste materials, rubbish and other <br />debris resulting from the Work, and at the completion of the Work he will remove all waste materials, <br />GC 25 <br />
