G. Contractor must submit any Change Proposal seeking an adjustment in Contract Price or <br />Contract Times under this paragraph within 30 days of the commencement of the delaying, <br />disrupting, or interfering event. <br />ARTICLE 5 — AVAILABILITY OF LANDS; SUBSURFACE AND PHYSICAL CONDITIONS; HAZARDOUS <br />ENVIRONMENTAL CONDITIONS <br />5.01 Availability of Lands <br />A. Owner shall furnish the Site. Owner shall notify Contractor of any encumbrances or <br />restrictions not of general application but specifically related to use of the Site with which <br />Contractor must comply in performing the Work. <br />B. Upon reasonable written request, Owner shall furnish Contractor with a current statement <br />of record legal title and legal description of the lands upon which permanent improvements <br />are to be made and Owner's interest therein as necessary for giving notice of or filing a <br />mechanic's or construction lien against such lands in accordance with applicable Laws and <br />Regulations. <br />C. Contractor shall provide for all additional lands and access thereto that may be required for <br />temporary construction facilities or storage of materials and equipment. <br />5.02 Use of Site and Other Areas <br />A. Limitation on Use of Site and Other Areas: <br />1. Contractor shall confine construction equipment, temporary construction facilities, the <br />storage of materials and equipment, and the operations of workers to the Site, <br />adjacent areas that Contractor has arranged to use through construction easements or <br />otherwise, and other adjacent areas permitted by Laws and Regulations, and shall not <br />unreasonably encumber the Site and such other adjacent areas with construction <br />equipment or other materials or equipment. Contractor shall assume full responsibility <br />for (a) damage to the Site; (b) damage to any such other adjacent areas used for <br />Contractor's operations; (c) damage to any other adjacent land or areas; and (d) for <br />injuries and losses sustained by the owners or occupants of any such land or areas; <br />provided that such damage or injuries result from the performance of the Work or <br />from other actions or conduct of the Contractor or those for which Contractor is <br />responsible. <br />2. If a damage or injury claim is made by the owner or occupant of any such land or area <br />because of the performance of the Work, or because of other actions or conduct of <br />the Contractor or those for which Contractor is responsible, Contractor shall (a) take <br />immediate corrective or remedial action as required by Paragraph 7.12, or otherwise; <br />(b) promptly attempt to settle the claim as to all parties through negotiations with <br />such owner or occupant, or otherwise resolve the claim by arbitration or other dispute <br />resolution proceeding, or at law; and (c) to the fullest extent permitted by Laws and <br />Regulations, indemnify and hold harmless Owner and Engineer, and the officers, <br />directors, members, partners, employees, agents, consultants and subcontractors of <br />each and any of them from and against any such claim, and against all costs, losses, <br />and damages (including but not limited to all fees and charges of engineers, architects, <br />attorneys, and other professionals and all court or arbitration or other dispute <br />resolution costs) arising out of or relating to any claim or action, legal or equitable, <br />brought by any such owner or occupant against Owner, Engineer, or any other party <br />indemnified hereunder to the extent caused directly or indirectly, in whole or in part <br />EJCDC® C-700, Standard General Conditions of the Construction Contract. <br />Copyright © 2013 National Society of Professional Engineers, American Council of Engineering Companies, <br />and American Society of Civil Engineers.
