policy. Such named insured shall act as fiduciary for the other insureds, and give notice to
<br />such other insureds that adjustment and settlement of a claim is in progress. Any other
<br />insured may state its position regarding a claim for insured loss in writing within 15 days
<br />after notice of such claim.
<br />B. Proceeds for such insured losses may be made payable by the insurer either jointly to
<br />multiple insureds, or to the named insured that purchased the policy in its own right and as
<br />fiduciary for other insureds, subject to the requirements of any applicable mortgage clause.
<br />A named insured receiving insurance proceeds under the builder's risk and other policies of
<br />insurance required by Paragraph 6.05 shall distribute such proceeds in accordance with
<br />such agreement as the parties in interest may reach, or as otherwise required under the
<br />dispute resolution provisions of this Contract or applicable Laws and Regulations.
<br />C. If no other special agreement is reached, the damaged Work shall be repaired or replaced,
<br />the money so received applied on account thereof, and the Work and the cost thereof
<br />covered by Change Order, if needed.
<br />ARTICLE 7 — CONTRACTOR'S RESPONSIBILITIES
<br />7.01 Supervision and Superintendence
<br />A. Contractor shall supervise, inspect, and direct the Work competently and efficiently,
<br />devoting such attention thereto and applying such skills and expertise as may be necessary
<br />to perform the Work in accordance with the Contract Documents. Contractor shall be solely
<br />responsible for the means, methods, techniques, sequences, and procedures of
<br />construction.
<br />B. At all times during the progress of the Work, Contractor shall assign a competent resident
<br />superintendent who shall not be replaced without written notice to Owner and Engineer
<br />except under extraordinary circumstances.
<br />7.02 Labor; Working Hours
<br />A. Contractor shall provide competent, suitably qualified personnel to survey and lay out the
<br />Work and perform construction as required by the Contract Documents. Contractor shall at
<br />all times maintain good discipline and order at the Site.
<br />B. Except as otherwise required for the safety or protection of persons or the Work or
<br />property at the Site or adjacent thereto, and except as otherwise stated in the Contract
<br />Documents, all Work at the Site shall be performed during regular working hours, Monday
<br />through Friday. Contractor will not perform Work on a Saturday, Sunday, or any legal
<br />holiday. Contractor may perform Work outside regular working hours or on Saturdays,
<br />Sundays, or legal holidays only with Owner's written consent, which will not be
<br />unreasonably withheld.
<br />7.03 Services, Materials, and Equipment
<br />A. Unless otherwise specified in the Contract Documents, Contractor shall provide and
<br />assume full responsibility for all services, materials, equipment, labor, transportation,
<br />construction equipment and machinery, tools, appliances, fuel, power, light, heat,
<br />telephone, water, sanitary facilities, temporary facilities, and all other facilities and
<br />incidentals necessary for the performance, testing, start up, and completion of the Work,
<br />whether or not such items are specifically called for in the Contract Documents.
<br />B. All materials and equipment incorporated into the Work shall be of good quality and new,
<br />except as otherwise provided in the Contract Documents. All special warranties and
