D. Effect of Engineer's Determination: Neither approval nor denial of an "or -equal" request <br />shall result in any change in Contract Price. The Engineer's denial of an "or -equal" request <br />shall be final and binding, and may not be reversed through an appeal under any provision <br />of the Contract Documents. <br />E. Treatment as a Substitution Request: If Engineer determines that an item of material or <br />equipment proposed by Contractor does not qualify as an "or -equal" item, Contractor may <br />request that Engineer considered the proposed item as a substitute pursuant to Paragraph <br />7.05. <br />7.05 Substitutes <br />A. Unless the specification or description of an item of material or equipment required to be <br />furnished under the Contract Documents contains or is followed by words reading that no <br />substitution is permitted, Contractor may request that Engineer authorize the use of other <br />items of material or equipment under the circumstances described below. To the extent <br />possible such requests shall be made before commencement of related construction at the <br />Site. <br />1. Contractor shall submit sufficient information as provided below to allow Engineer to <br />determine if the item of material or equipment proposed is functionally equivalent to <br />that named and an acceptable substitute therefor. Engineer will not accept requests <br />for review of proposed substitute items of material or equipment from anyone other <br />than Contractor. <br />2. The requirements for review by Engineer will be as set forth in Paragraph 7.05.B, as <br />supplemented by the Specifications, and as Engineer may decide is appropriate under <br />the circumstances. <br />3. Contractor shall make written application to Engineer for review of a proposed <br />substitute item of material or equipment that Contractor seeks to furnish or use. The <br />application: <br />a. shall certify that the proposed substitute item will: <br />1) perform adequately the functions and achieve the results called for by the <br />general design, <br />2) be similar in substance to that specified, and <br />3) be suited to the same use as that specified. <br />b. will state: <br />1) the extent, if any, to which the use of the proposed substitute item will <br />necessitate a change in Contract Times, <br />2) whether use of the proposed substitute item in the Work will require a <br />change in any of the Contract Documents (or in the provisions of any other <br />direct contract with Owner for other work on the Project) to adapt the <br />design to the proposed substitute item, and <br />3) whether incorporation or use of the proposed substitute item in connection <br />with the Work is subject to payment of any license fee or royalty. <br />c. will identify: <br />1) all variations of the proposed substitute item from that specified, and <br />EJCDC® C-700, Standard General Conditions of the Construction Contract. <br />Copyright © 2013 National Society of Professional Engineers, American Council of Engineering Companies, <br />and American Society of Civil Engineers.
