Minnesota Department of Transportation EEO Special Provisions <br />Office of Civil Rights <br />Revised 07/12 <br />NOTICE TO ALL PRIME AND SUBCONTRACTORS <br />PRE -AWARD REPORTING REQUIREMENTS <br />In order to ensure compliance with Federal and State laws and regulations (23 USC 140, and 23 CFR 230, and <br />Minnesota Statutes §363A.36) and to ensure Mn/DOT's ability to monitor and enforce compliance efforts, the <br />following requirements apply if the apparent low bid exceeds $ 5,000,000.00: <br />1) The Apparent Low Bidder ("ALB") must provide to Mn/DOT the "EEO-8 Form" (also entitled <br />"EEO Compliance Review Report"), which must provide detail on the contractor's total company <br />workforce in the State of Minnesota during the twelve month period preceding July 30th of the previous <br />year (Office and/or clerical personnel need not to be included). <br />2) The ALB must provide to Mn/DOT a work plan for meeting the minority and women employment <br />goals established by the Minnesota Department of Human Rights, for the project in question. The work <br />plan must include, at a minimum (1) how the ALB will incorporate its current minority and women <br />employees in the ALB's efforts to meet the established goals; and (2) a contingency plan if the ALB has <br />determined that its current workforce is not sufficient in order to achieve the established employment <br />goals. If the ALB relies in whole or in part upon unions as a source of employees, then the ALB must <br />(1) include a list of established organizations that are likely to yield qualified minority and women <br />candidates if those union(s) are unable to provide a reasonable flow of minority and women candidates <br />in their work plan; and (2) document the method by which these organizations will refer candidates to <br />the ALB for employment opportunities. All bidders are hereby notified that the U.S. Department of <br />Labor has determined that a contractor will not be excused from complying with the Federal and State <br />laws and regulations cited above based solely on the fact that a contractor has a collective bargaining <br />agreement with a union providing for the union to be the exclusive source of referral and that the union <br />failed to refer minority employees. A contractor may obtain a list of organizations likely to yield <br />qualified minority and women candidates from the Mn/DOT Office of Civil Rights. <br />3) The ALB must provide to Mn/DOT the ALB's total workforce and labor projections for the project <br />(represented in hours), the ALB's projected total number of minority hours for the project, and the <br />ALB's projected total number of women hours for the project. The details must include the trade(s) that <br />will be utilized in order to complete the project. <br />The ALB must submit documents as required to comply with this section no later than five business days after the <br />date that bids for the contract are opened. The five day period starts the business day following the date that bids <br />were opened. The required documents must be received prior to Contract Award, and must be sent to the Mn/DOT <br />Office of Civil Rights — 395 John Ireland Blvd., Mail Stop 170 St. Paul, MN 55155-1899. Submittal of the <br />documents described in (1), (2) and (3) is required for contract award to the ALB. The submitted documents will <br />be used as a tool to assist contractors in meeting employment goals; the content itself will not be evaluated for the <br />purpose of determining contract award. <br />EEO Page 3 <br />
