City Staff has come to the conclusion that the classification of Rogers Lake should be changed <br />back to a Natural Environment Lake. To do so requires an amendment to Ordinance 04-32 <br />adopted on August 10. <br />Citizen Input <br />Staff noted receipt of a petition with three signatures wanting Rogers Lake to remain a <br />recreational lake. <br />Mr. Jeff Rocco wondered as far as any future additions or out building, how would this affect it <br />by changing it back to natural environment water. <br />Ms. Frolik stated most additions would need a variance; the extent of the variance depends on <br />whether Rogers Lake is natural or recreational. <br />Commissioner Jeffrey wondered if the DNR needed to approve variances if this was turned back <br />to a natural environment lake. <br />Ms. Frolik stated the DNR would need to certify a variance. <br />Acting Chairperson Johnson stated his concern was if this was turned back to a natural <br />environment lake, variances may not be approved by the DNR because of the more stringent <br />regulations. <br />Commissioner Brauer stated homes are already on the lake and he did not think the lake would <br />deteriorate more because of added homes and run off. <br />Mr. Richard Giddings, 18001 Ute Street stated the residents concern was setback requirements <br />for construction. <br />Ms. Frolik stated if the Commission wanted to leave Rogers Lake as a recreational lake, they <br />could write up a justification report but if the justification report is rejected by the DNR, the lake <br />will go back to a natural environment lake. <br />Mr. Giddings asked how this would affect a resident wanting to add a deck or addition onto their <br />home. <br />Acting Chairperson Johnson stated there may be a problem getting this approved by the DNR. <br />Motion by Commissioner Jeffrey, seconded by Commissioner Brauer, to close the public hearing. <br />Motion Carried. Voting Yes: Acting Chairperson Johnson, Commissioners Jeffrey, Brauer, <br />Shepherd, and Watson. Voting No: None.
