responsible to perform or pay for the cost of any obligation concerning Streetscape Construction. <br />The City shall not assess the Secondary Developer or the Property any amounts for the <br />Streetscape Construction and the City waives any right to levy an assessment for the Streetscape <br />Construction. Further, the City is precluded from levying an assessment against the Secondary <br />Developer and the Property pursuant to Section 11.1 or -Section 11.2 of the Master Development <br />Agreement. The Secondary Developer's Streetscape Construction shall be constructed by the <br />Secondary Developer in accordance with the plans for the Ramsey Town Center 3`d Addition, <br />Ramsey, Minnesota, titled Final Plat and Final Engineering - Commercial Development Phase I, <br />dated September 27, 2004, sheet nos. 45-61, with a plot date for these plans of 9/01/2004. <br />These plans have been approved by the City and constitute the Phase I Landscape Plan and Phase <br />II Landscape Plan under the Master Development Agreement for the Property. These plans <br />contain all of the improvements for the Streetscape Construction and no other improvements <br />shall be required to be constructed for the Streetscape Construction related to the Property. The <br />costs associated with Streetscape Construction are not eligible as a credit towards the Trail <br />Development Fees and/or Park Dedication requirements due on the Plat. As security to ensure <br />the completion of Secondary Developer's limited Streetscape Construction, Master Developer <br />shall provide escrow funds in accordance with the Escrow Agreement from proceeds of the sale <br />of the Property to Secondary Developer in the amount of $148,830.00. <br />1.4. Mass Grading and Storm Water Construction. The Master Developer is <br />responsible, at its cost and expense, to perform mass grading and to construct a storm water <br />management system to serve the Ramsey Town Center in accordance with Section 10.1 of the <br />Master Development Agreement ("Grading and Storm Water Construction"). Secondary <br />Developer shall not be responsible to perform or pay for the cost of any obligation concerning <br />Grading and Storm Water Construction. The City shall not assess the Secondary Developer or <br />the Property any amounts for the Grading and Storm Water Construction and the City waives <br />any right to levy an assessment for the Grading and Storm Water Construction. Further, the <br />City is precluded from levying an assessment against the Secondary Developer and the Property <br />pursuant to Section 10.1 of the Master Development Agreement. <br />15. Zeolite Street Construction. The City hereby authorizes the Secondary Developer <br />to construct a portion of Zeolite Street NW south of Sun_ wood Drive together with a temporary <br />cul-de-sac along Civic Center Drive, all in accordance with the plans for the Ramsey Town <br />Center 3`d Addition, Ramsey, Minnesota, titled Final Plat and Final Engineering - Commercial <br />Development Phase I, dated September 27, 2004, sheet nos. 63-66, with a plot date for these <br />plans of 9/01/2004 ("Zeolite Improvements"). These plans for the Zeolite Improvements have <br />been approved by the City and contain all of the improvements for the Zeolite Improvements and <br />no other improvements shall be required to be constructed for the Zeolite Improvements by the <br />Secondary Developer. <br />The Zeolite Improvements shall be constructed within the platted right-of-way dedicated to the <br />public in the plat of Ramsey Town Center Addition, except for a portion of the temporary cul-de- <br />sac that is located in Outlot M, Ramsey Town Center Addition. Outlot M is owned by the <br />Master Developer and the Master Developer agrees to provide the City with a temporary road <br />easement until Civic Center Drive is constructed.
