CASE # I C) <br />ADOPT ORDINANCE TO VACATE EASEMENT IN RAMSEY <br />TOWN CENTER ADDITION; CASE OF RAMSEY TOWN CENTER LLC <br />By: Sylvia Frolik, Community Development Director <br />Background: <br />As part of the development associated with Ramsey Town Center 3`d Addition, the drainage and <br />utility casements on the underlying Outlot I, Ramsey Town Center, will need to be vacated. They <br />will be replaced with new drainage and utility easements as part of the new plat. The following <br />items are enclosed for your information: <br />a) Site location map <br />b) Exhibit of underlying easements to be vacated <br />c) Proposed Ordinance <br />Observations: <br />On July 27, 2004, the City Council introduced an ordinance to vacate the drainage and utility <br />easement over Outlot I, Ramsey Town Center Addition. Final adoption of the ordinance was <br />withheld until the final plat was submitted for approval to ensure that replacement easements <br />were properly dedicated. The final plat was approved on October 12, 2004. The final adoption <br />of the easement vacation ordinance was tabled on October 12 and 26 because the City had not <br />received a written commitment from Ramsey Town Center, LLC accepting responsibility for <br />additional storm sewer costs resulting from vacating the existing easement. <br />Recommendation: <br />City Staff recommends adoption of the ordinance contingent upon receipt of the written <br />commitment. <br />Council Action: <br />Motion to adopt Ordinance #04-10- to vacate the drainage and utility easements contained <br />on Outlot 1, Ramsey Town Center Addition. <br />Roll Call Vote: Councilmember Al Pearson <br />Councilmember David Elvig <br />Councilmember Sarah Strommen <br />Councilmember Jerry Zimmerman <br />Councilmember Todd Cook <br />Councilmember Patti Kurak <br />Mayor Tom Gamec <br />Review Checklist: <br />Asst.
