Assistant Community Development Director Trudgeon stated staff received the letter from Mr. <br />and Mrs. Abendroth and Associate Planner Geisler talked to them and answered the questions. <br />He reviewed the following questions from the letter: <br />■ Has the property been inspected since the original variance was issued? He explained <br />these properties are periodically reviewed. Staff was not able to find the last time the <br />property was inspected. The property has had a conditional use permit since 1993. <br />■ Has the property been inspected since the new rental requirements went into effect? He <br />explained this license was just created last year. The City has not been out there to <br />inspect the property for a rental purpose, as it currently is not rented. The people that <br />own it occupy both sides at this time. However, the Building Inspector did look at it and <br />found it generally in order with the exception of a fire door between the two units that <br />would need to be improved. <br />■ Will there be an inspection of the property before a decision is made? He explained the <br />City has been out there unofficially already, and it is up to the Council to decide if further <br />inspection is needed. <br />■ How many people can occupy the property? He indicated under the original conditional <br />use permit there are no restrictions on the number of people. The City Code limits this, <br />and he believes the Code states that any occupancy cannot be more than two people per <br />bedroom, depending on the number of bedrooms. <br />■ What happens if the pending sale fails and the permit has been issued? He explained <br />there is currently a conditional use permit on this. One side could still be rented under the <br />term of the original conditional use permit, but one side would need to be owner <br />occupied. <br />Assistant Community Development Director Trudgeon indicated the last couple of comments he <br />is not sure if lie can directly answer. The letter discusses previous cases or precedents in the <br />community. The Council's packet includes a listing of accessory apartments or multiple <br />dwellings in the City of Ramsey. This particular use is the only one that is restricted to owner <br />occupancy on one side. Included in the Council's packet are positive findings of fact as was <br />directed at the Council worksession when this was discussed. <br />Jacqueline Abendroth, 15810 Sodium Street NW, stated they are all neighbors of the property <br />here tonight, most of them for over 20 years, and they are all objecting to this. She thanked the <br />Council for their consideration. <br />Mayor Gamec stated this particular issue is a difficult one for the Council to deal with, but if they <br />put restrictions on this property and find a problem they can get in there and do some work or <br />recommend work to be done. They will continue to monitor the property and the citizens can <br />contact the City if there are problems. There are restrictions on the conditional use permit and <br />they feel there are enough restrictions on this. <br />Motion by Councilmember Cook, seconded by Councilmember Pearson, to adopt Resolution <br />404-1.0-325 adopting Findings of Fact #0704 relating to the request for an amended Conditional <br />Use Permit to allow an accessory apartment in a single family structure in the R-1 Residential - <br />Rural Developing District. <br />City Council/October 26, 2004 <br />Page 8 of 15 <br />
