CASE #: ~ <br /> <br />REQUEST FOR A VARIANCE TO THE.. 4 UNITS IN 40 ACRES DENSITY <br />RESTRICTION AND LOT SIZE; <br /> CASE OF ROBERT LONGFEELD <br /> By: Principal Planner Patrick Trudgeon <br /> <br />Background: <br /> <br />Mr. Bob Longfield resides on a 10 acre parcel at 5751 177t~ Ave. N.TM. The applicant is <br />requesting a variance to the 4 in 40 density restriction and mn/mum lot size of 10 acres. The <br />applicant is proposing to subdivide his lot to create a new 2.06 acre lot and keep a 7.94 acre lot <br />for his homestead. <br /> <br />Staff informed the applicant that the recently adopted Comprehensive Plan removed the 4 in 40 <br />density restriction .and reduce the minimum lot size. The revised zoning ordinance making these <br />changes is currently being considered by the City Council. The applicant is proceeding now in <br />anticipation of the proposed changes. <br /> <br />The following items are enclosed: <br /> <br />a) <br />b) <br />e) <br /> <br />Site location map <br />Proposed subdivision <br />Proposed findings of fact <br />Proposed variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff notified property owners within 350 feet of the subject <br />property of the request for variance and public hearing. <br /> <br />Observations: <br /> <br />The Longfield property is surrounded by lots of various lot siZes, ranging from 2.5 acres to 40 <br />acres. Part of the reason the Comprehensive Plan reduced the density to 1 unit per 2.5 acres in <br />this area is because the development that occurred prior to 1990 already exceeded 4 units in 40 <br />acres and therefore it is not a realistic standard to be achieved. <br /> <br />The Board of Adjustment has granted variances to the 4 in 40 density restriction in the past. In <br />December 2000, a variance was granted to Derek Nordvick to create two 2.5 acre parcels from <br />an existing 5-acre parcel. The Board has also granted a variance to the minimum lot size of 10 <br />acres in May 1998 when John Gobernatz was granted a variance to create several 2.5 acre <br />parcels. The Gobernatz parcels are also located on 177th Ave. and are across from the applicant's <br />property. As the Board of Adjustment knows, in order to grant a variances, there must be a <br />determination that there is some physical uniqueness about the property that is causing the <br /> <br /> <br />
