CASE

REQUEST FOR A VARIANCE TO ENCROACH THE FRONT YARD SETBACK
CASE OF JEFF AND JEANINE HACKERT
By: Megan Wald, Associate Planner

Background:

The City, received an application from Jeff and Jeanme Hackert who lives at 5600 142nd Avenue
to construct an addition onto their e,-,dsting home that would encroach the 40-foot front yard
setback restriction for R-IR Single Family Rural properties. Staff conducted an on site
inspection of the subject property to gather further data regarding the applicant's variance request
on May 29, 2002. During the inspection, Staff learned that the applicant could meet the 30-foot
front yard setback for properties located w/thin the MUSA boundary that is being proposed for
the R-1 district as part of the zoning code rewrite. The City Council introduced the new
residential zoning regulations on May 28, 2002. The City Council will take final action on the
new residential standards on June 11, 2002.

Once the new residential ordinance becomes effective, the va.dance will no longer be needed.
The applicant will be able to meet the 30-foot setback 1/ne and construction of the addition will
most likely not be underway until early July.

BOA: 6.06.02
