Councilmember Johns introduced the following resolution and moved for its adoption: <br />RESOLUTION #17-07-178 <br />RESOLUTION APPROVING AN ENCROACHMENT AGREEMENT FOR A DECK TO <br />BE PARTIALLY LOCATED IN A DRAINAGE AND UTILITY EASEMENT ON THE <br />PROPERTY GENERALLY KNOWN AS 7190 167th TERRACE NW AND DECLARING <br />TERMS OF SAME <br />WHEREAS, Justin and Amanda Hora, hereinafter referred to as the "Applicant," have <br />requested an Encroachment Agreement to allow a 13' x 32' deck (the "Deck") to be partially <br />located in a drainage and utility easement (the "Easement") on the property legally described as <br />follows: <br />Lot 9, Block 3 Brookfield 2nd Addition <br />(the "Subject Property"). <br />WHEREAS, the Applicant applied for a Building Permit to construct the Deck on the <br />Subject Property; and <br />WHEREAS, the Deck will partially encroach into. the Easement; and <br />WHEREAS, the Engineering Department has found that the Easement can still function <br />with the encroachment of the Deck. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That, contingent upon the Applicant entering into an Encroachment Agreement with the City <br />and recording said agreement against the Subject Property, the Applicant may construct and <br />maintain the Deck in accordance with the terms and conditions contained within the <br />Encroachment Agreement. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Williams, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Strommen <br />Councilmember Johns <br />Councilmember Williams <br />Councilmember Kuzma <br />Councilmember LeTourneau <br />Councilmember Riley <br />Councilmember Shryock <br />
