Board Member <br /> <br />introduced the following resolution and moVed for its adoptiOn: <br />RESOLUTION #02-11 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE .OF A VARIANCE TO RONALD <br />CANNER, JR., (PERMITTEE) FROM THE REQUIRED SETBACKS FROM THE <br />ORDINARY HIGH WATER MARK AND THE COUNTY ROAD IN THE ROGERS <br />LAKE SHORELAND OVERLAY DISTRICT AND DECLARING TERMS OF SAME <br /> <br /> WHEREAS, Ronald Carmer, Jr., ("Permittee") has properly applied for a variance from <br />Section 9.21.04 of the Ramsey City 'Code to develop a parcel and encroach on the required <br />setback from ordinary high water mark and the COunty Road in the Rogers Lake Shoreland <br />Overlay District on the property generally located on the north side of 179th Lane N.W. (County <br />Road #27), approximately 330 feet east of C.S.A.H. #7, and proposed to be platted and legally <br />described as follows: <br /> <br />Lot 1, Block I, L.P. Keillor Addition, Anoka County,.Mirmesota <br /> <br />(Subject Property). <br /> <br /> AND WHEREAS, the Board of Adjustment conducted a public hearing on November 7, <br />2002, pursuant to Section 9.03.05 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That based on Findings of Fact # ., a variance to encroach into the two-hundred (200) <br />foot ordinary high water mark setback and the 50 foot County road Setback in the Rogers <br />Lake Shoreland Overlay District is hereby granted. <br /> <br />That the all structures constructed on the Subject Property shall maintain a one-hUndred (100) <br />foot setback from the Ordinary High Water (OHW) mark of Rogers Lake and a 40 foot <br />setback from the County Road #27 fight-of-way, as dedicated on the proposed plat of L.P. <br />Keillor Addition. <br /> <br />That the Permittee shall obtain all necessary permits prior to commencing any construction. <br />No building permit shall be issued until the Permitiee has recorded the plat of L.P. Keillor <br />Addition to creme the Subject Property at the offices of Anoka County, signed the variance <br />and reimbursed the City for all costs incurred in processing the variance applicatiom <br /> <br />That the property owner shall be responsible for all. City costs incurred in,administering and <br />enforcing this variance. <br /> <br />5. That this Variance shall automatically expire if the use is not initiated by November 7, 2003. <br /> <br />15 <br /> <br /> <br />
