Board Member introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-11 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO KEVIN AND <br />CHRISTINE GRAPHENTEEN (PERMITTEES) AT 14670 FLUORINE ST. NW FOR <br />THE SIDE YARD SETBACK FOR CORNER LOTS AND DECLARING TERMS OF <br />SAME <br /> <br /> WHEREAS, Kevin and Christine Graphenteen ("Permittees") have properly applied for <br />a variance from Section 9.20.11 of the Ramsey City Code to leave a detached accessory structure <br />that encroaches twenty-six feet into the side yard setback for comer lots on the property generally <br />known as 14670 Fluorine St. NW and legally described as follows: <br /> <br />Lot 11, Block '2, Sunny Ponds 3'a Addition, Anoka County, Minnesota <br /> <br /> (Subject Property). . <br /> <br /> AND WHEREAS, the Board of Adjustment conducted a public hearing on November 7, <br />2002, pursuant to Section 9.03.05 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF-THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That based on Findings of Fact # , a variance to encroach into the 30-foot side yard <br />setback for comer lots on the Subject Property is hereby granted. <br /> <br />That the detached accessory structure shall maintain a four (4) foot setback from the side <br />proi~:~rty line along 146th Avenue. <br /> <br />o <br /> <br />That the property owner shall' 'be responsible for all City costs incurred in administering and <br />enforcing this variance.. <br /> <br />That the accessory strdcture shall be used for storage of personal property and that no <br />commercial activity of any type shall be permit-ted in said structure, unless it is in accordance <br />with' City Code. <br /> <br />5. That this Variance shall automatically expire if the use is not initiated by November 7, 2003. - <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> ., and upon vote being taken thereon, the following voted in favor thereof:' <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br />45 <br /> <br /> <br />
